Phillip Parker, 14: Bullied for being gay, he felt life was not worth living.

Gordonsville, Tennessee – The body of a 14-year-old gay boy was found by his parents and grandparents Friday, along with a suicide note begging his mother to help him. Phillip Parker committed suicide after being relentlessly bullied for his sexual orientation at Gordonsville High School. WSMV reports that Parker’s parents learned the magnitude of the bullying problem in the school only after he took his life.

This latest gay teen suicide takes place in a state riven with anti-gay controversy.  Recent “Don’t Say Gay,” “License to Bully,” and anti-transgender “Bathroom” bills are making their way through the Tennessee State Legislature, all attempting to stigmatize and debase LGBTQ people. Correlations have been made between high profile anti-gay news stories and a heightened number of violent incidents involving LGBTQ people around the nation.

Young Phillip was the person most likely to tell friends they were beautiful.  His mom said he was energetic, loving, fun, and happy.  But his grandmother reported to WSMV that he confided to her that he was burdened by the bullying, “like he had a big rock on his chest.”  The family said they had complained about the bullying to school officials, but the problem only got worse.

News 5 reports that over a hundred contacts with the Parker family after Phillip’s death added details to the bullying situation at the school. The family said some of these stories showed just how obvious the anti-gay bullying had become there.  His grandfather, Paul Harris, said to News 5: “Because he was gay, he got mistreated physically, mentally by several people out there at the school, and I am very resentful as a result of it. A sweet kind person like Phillip took it out on himself, he killed himself to get out of the pain.” 

No cause of death has yet been officially released by law enforcement authorities.  School officials have not returned calls for comment to the press.

Russellville, Arkansas – Jake Burris, campaign manager for Democratic Congressional candidate Ken Aden, came home with his four children to find their pet cat slaughtered on the front porch.  ”LIBERAL” was scrawled in magic marker on the lifeless body. In a clear example of terrorism, the innocent animal had been bashed in the head and left so that it could not be missed by Burris, who is locked in a tight campaign struggle against a right-wing Republican opponent to elect his candidate to the U.S. House of Representatives.  But instead of Burris finding the carcass of the family pet before his children, his little boy found their kitty first.  Blue Arkansas wrote movingly about this atrocity:

“This is terrorism.  There’s no other word for it.  A police report has been filed.  Jake said the kids seem to be handling it okay.  The one that discovered the cat was too young to be able to read and Jake had quickly gotten the others into the house before they saw it.  Pope County is an insanely conservative area and the Aden campaign has been shaking things up even there and it looks like another right wing sociopath with a taste for violence has come crawling out of the woodwork in response.  I asked Aden for a comment on the record:

‘“This is sickening.  To kill a child’s pet…I’m at a loss for words…I’ve seen the best and the worst of humanity, but this is something else.”’

Defenseless, innocent victims pay the price of hate ideology and violence first–our pets.  Violence against human victims is underreported, but statistics on this dimension of hate violence are non-existent. The numbers of pets slain in hate killings must be astronomical. Political liberals, progressives, LGBTQ people, women, racial/ethnic minorities have all experienced the terrible shock, anger, and raw fear Jake Burris and his family faced yesterday at the hands of irrational hate groups who send a message of terror by killing cats, dogs, birds and other family pets.

The murder of pet animals is often a prelude to anti-human violence.  Gay man Charlie Howard found his cat dead on the front steps of his apartment in Bangor, Maine with its neck broken shortly before a gang of Bangor’s youth threw him off the State Street Bridge. Friends of Charlie’s said that after he found his cat killed, he became depressed and fearful. He had every reason to be, as it turned out. Charlie drowned in Kenduskeag Stream because three boys hated him because of his sexual orientation.  The pet killing was a telegraphic message of homophobia, sent from people who warmed up to killing Charlie by taking the life of his companion.

I know the feeling that terrorized Charlie Howard and that the Jake Burris and his family face now.  In the early 1990′s, I came home from pastoral hospital visits to parishioners to find my English Bulldog Buck and my Basset Hound Beau butchered, hanging up in a tree in my Eastern NC parsonage yard.  Anonymous opponents suspected I was gay, and tried to drive me out of the church I was serving by slaughtering my pets.  In those days, I lived a single, closeted life, serving churches with the fear of discovery of my sexual orientation. My dogs were my only companions, and paid the ultimate price because cowards thought I would run.  I did not run.  I stayed at the church and fought back successfully.  But the loss is still with me.

Reuters reports that the campaign of Republican incumbent Steve Womack, Aden’s opponent in the heavily conservative 3rd District of Arkansas, has condemned the killing of Burris’s cat.  Candidate Aden and Burris said they do not believe anyone in the Womack campaign perpetrated the crime.  The Russellville Police Department is treating this incident as an animal cruelty case, and the investigation is ongoing. But the fact remains that the atmosphere of irrational hatred propounded by unreasoning prejudice is lethal.

Jake Burris told Blue Arkansas, “I’ve got a gun and I know how to use it. If I have to protect my kids I’ll do it without hesitation.”  

We have a duty to all life to find a cure for hate.  Our pets pay as terrible a price as we do because of hate violence.  Perhaps the shock of a story like this can awaken the consciences of our neighbors to work with us to create a world safe for all creatures to live without fear.    ~ Stephen V. Dallas, Texas – A blog site created to change the conversation on anti-LGBTQ hate crimes hosted the 250K visitor today, marking a milestone in cyberspace.  Unfinished Lives Blog broke the quarter million hit barrier Tuesday morning, January 10, fueled by intense interest in gay bashing stories from Wisconsin, California, and the Republic of the Philippines.

Created by Dr. Stephen Sprinkle, the author of Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims (Resource Publications, 2011) as “a place of public discourse which remembers and honors LGBTQ hate crime victims, while also revealing the reality of unseen violence perpetrated against people whose only ‘offense’ is their sexual orientation, gender identity, or gender presentation,” the blog has to date posted 432 articles relating to overcoming violence against sexual and gender dissidents in 370 categories.  Assisted by the Unfinished Lives Project Team, the blog ginned up in June 2008, and gradually gained a loyal readership, becoming a trusted source on hate-crimes-related issues affecting Lesbian, Gay, Bisexual, Transgender and Queer people.

Originally, the site appealed to colleagues at Brite Divinity School, students, and interested North Texans.  Early on, however, the blog began to gain a national and international constituency.  As of this date, the top ten U.S. states represented by hits are (in rank order) California, Texas, New York, Florida, North Carolina, Georgia, Pennsylvania, Illinois, Ohio, and New Jersey, with all 50 states, U.S. Territories and the District of Columbia represented. Internationally, readers from Canada, Great Britain, Germany, Australia, Brazil, France, the Netherlands, Mexico, Italy, and Spain lead the pack, with the Philippines, India, Indonesia and Taiwan leading Asian visitors, and South Africa, Egypt, Algeria, and Nigeria contributing the most readers from Africa. In all, Unfinishedlivesblog.com counts readers and followers from 174 foreign countries and territories.

One distinctive feature of Unfinished Lives Blog is its combination of reportage, ethnography, theological orientation, and academic origins.  Few academically-originated blogs reach the number of people this one consistently does.

The month of January will be a time of appreciation and celebration in the life of this blog.  Highlighted for thanks and recognition are four groups: the Endorsers of this blog and the Unfinished Lives book, the growing number of Followers (now more than 470 official Followers!), the Unfinished Lives Project Team support staff, and, of course, the 250K readers without whom this effort would be a lone voice in the dark.

This effort has no paid staff, no advertising to defray expenses, and no full-time personnel.  Instead, this blog has been and remains a labor of love and remembrance.  No end to the violence perpetrated against LGBTQ people is yet in sight.  We cannot, will not forget the women, men, and youths cut down by irrational hatred because of their real or perceived sexual orientation, gender identity, and gender presentation. Their families, friends, and lovers are dear to us. Their attackers and murderers are in our prayers. The work of this blog is in no wise done–there is so much more remaining to do until hate violence is erased.  So, we who believe in Justice cannot rest–we who believe in Justice cannot rest until it comes!

Matthew O'Brien-Veader, on trial for the brutal murder of a homeless disabled man he believed made a sexual advance toward him.

Waterbury, Connecticut – Police officials say that a Waterbury man savagely murdered a homeless disabled man living in the same abandoned factory because of an alleged sexual advance.  Matthew O’Brien-Veader, 23, took shelter in the derelict warehouse along with his alleged victim, 39-year-old Joed Olivera, in June 2009.  During his sleep, O’Brien-Veader believed that the older disabled man attempted to have sex with him, and flew into a homophobic rage, according to the Republican American. Police arrested O’Brien-Veader June 12, 2009, and charged him with the grisly murder. He was bound over for trial in superior court, which finally began in Waterbury this week after a series of delays.

Court documents say that O’Brien-Veader attempted to throw Olivera down a flight of stairs, beat Olivera with his own pair of crutches until they shattered, and then repeatedly stabbed him with a dagger before throwing Olivera’s body through a jagged hole in the floor to the room below.  Others in the factory found Olivera’s body atop a jagged pile of junk, covered with a piece of plywood. One man who saw the mangled body of the homeless victim was so disturbed by the scene that he testified in in Waterbury Superior Court Tuesday to running out of the building and smoking marijuana to calm his nerves. O’Brien-Veader’s friend, Jason Benoit, testified that O’Brien-Veader had a deep aversion to LGBTQ people, and had told him that all gay people should be rounded up and dropped on a deserted island. According to the Hartford Courant, the defendant could receive a life sentence if found guilty.

O’Brien-Veader sat quietly beside his attorney as the case, postponed until over two years after the homicide, unfolded in the Waterbury courtroom. By invoking the gay panic defense, suggesting that the victim was responsible for his own murder, the defense hopes to cloud the minds of jurors enough to lighten the sentence, should their client be found guilty.  The recent King-McInerney gay killing in Oxnard, California gave the gay panic defense new life in American courts.  Defense attorneys for McInerney, a teen who confessed to the execution-style shooting of his teenaged gay classmate, Larry King, in front of a room full of witnesses, argued that unwanted sexual advances pushed McInerney to pull the trigger.  The ploy succeeded in reducing the conviction from murder to manslaughter.  O’Brien-Veader’s defense team is hoping that enough residual heterosexism and homophobia exists in jurors to bring a similar result for their client.

2011 was a year to remember.  The stories of the LGBTQ sisters and brothers who have died among us are windows through which we can see into our own souls.  Our ancestors are our teachers, if we will let them be.  At some point, I cannot pinpoint exactly when, I made the choice to still my powerful emotions around the murders of LGBTQ people, and let their stories teach me what it means to be alive.  That choice is one of the most important I have every made, and one of the most fruitful.  The book, Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims, was truly born in that moment.  Though I never met a one of the persons whose stories I tell in my book, they are very close to me–not in a morbid sense, at all.  I believe I can understand why so many gay folk would rather not remember how quickly our lives can be snuffed out.  But a truly community-shaping insight the dead have given me is that only the choice not to remember is morbid.  Re-telling the stories of those who have died among us because of who they were, gay men, lesbians, bisexual and transgender people, gives our community a new sense of how precious each life is, and a new resolve to be a justice-oriented people who treasure every moment we are given.

2011 is full of such memories for the LGBTQ community.  So many have faced terrible persecution, just to love whom they choose, just to live as they were created to live. We remember the young–so many of them–who found life too much to bear in a homophobic, bullying world.  We remember the transgender sisters, especially, who faced injustice everywhere they turned, and for whom living daily is an act of uncommon courage.  We remember the families, the lovers, the neighbors, the friends–and the killers, too.  Change comes at a glacial pace…so slowly.  But it comes.

Our dead have only died in vain if we refuse to remember and honor them.  Like the Mexican people know who treasure their dead on the Dia de los Muertos, the Day of the Dead, death is a stark reality however it comes.  But our friends south of the border also know how to tease death, argue with it, make fun of it, create works of art, song and dance out of it, and how to transcend the fear of death by gathering together to remember and cherish those who have died.  The LGBTQ community is learning how to do that, as well.  In Houston, Texas, right off of the Montrose, a memorial to LGBTQ people who have died has been created and dedicated this very year.  Everywhere I have gone this year to talk with people, more and more are finding the healing empowerment of remembrance.  Around the memories of our dead, extraordinary communities of strength, advocacy, and love have arisen.  These are all such good things, and they all have come about as gifts from our ancestors who have died among us.

We cannot, will not forget our fallen ancestors.  In their memories lies the key to becoming a true people of maturity, gratitude, justice, and hope.  That is the true fruit of remembrance for the LGBTQ community.  So, we who believe in justice cannot rest.  We honor and educate.  We recall, re-tell, and remember.  We push for justice, and then we push some more.  Our ancestors expect us to do no less.  And we, in their memories, can do no less.

Brandon McInerney pled guilty to the execution-style murder of his gay teen classmate, Larry Fobes King.

Ventura County, California – Prosecutors in the Brandon McInerney murder trail agreed to a plea deal rather than take young gay Larry King’s confessed killer into court a second time, according to EDGE Boston.  McInerney, 14 at the time he shot his 15-year-old gay classmate in the back of the skull in his middle school computer class in 2008, will be sentenced today.

The Ventura County District Attorney’s Office agreed to a deal because they couldn’t be sure what would happen if they put McInerney back on trial again.

McInerney’s defense team succeeded in putting King on trial for his own murder, at least enough so that the jury in the first trial could not agree on a verdict, and a mistrial was declared.  While legal experts saw the case as a clear-cut instance of pre-meditated murder, the prosecutors for Ventura County could not surmount the sympathy factor for the 14-year-old, and the discomfort factor in the way the press and the defense portrayed King.  Instead of the forthright homophobic murder the prosecution sought, a combination of child-nostalgia and anti-transgender and anti-gay bias turned King into a “Franken-Larry,” a devious, dangerous homosexual predator–a portrayal that could not have been further from the truth about the real boy who was in transition from a scared, bullied gay school kid to a youth who could affirm and live out his gender variance.

Media distortion in the King case started as early as the first reports about the murder, with sensational accounts of what young King wore to school, and his responses to McInerney’s bullying.  Ramin Satoodeh, reporter for Newsweek, wrote a cover story on King that was devastating–likening the boy to a monstrous little predator, tottering after his love interests in platform heels.  McInerney’s defense lawyers countered prosecution evidence of his Neo-Nazi and white supremacist motives by casting King, who was smaller and weaker than McInerney, as the aggressor, and skillfully used the press to drive this point home.  The California law making a 14-year-old prosecutable as an adult in heinous cases using firearms (which this case was in both particulars) was also put on trial in the media.

In the end, justice for Larry King was not the goal of a chastised district attorney’s office.  Assistant DA Mike Frawley said that they “took into consideration the time [McInerney would have to spend] in jail to protect the community.”  McInerney’s murder conviction has been stayed, and he will be sentenced to 11 years for voluntary manslaugher, and 10 years for the use of a firearm. With the four years he has already served in jail, McInerney will serve 25 years total.  Had the first-degree murder conviction been impose, he would have served 51 years.  Now, the confessed murderer of a young gay boy will be out on the street by his 39th birthday, and the dubious “gay panic defense” receives new life in the American legal system.

Geneva, Switzerland – A hard-hitting, historic report calling on the nations of the world to defend the rights of gay people has been issued by the Office of the High Commissioner of Human Rights of the United Nations in Geneva.  For the first time, the world body has detailed the the murder, bias-motivated violence, torture, police detention, discrimination in jobs, health care and education that LGBT people face on a daily basis because of their actual or perceived sexual orientation or gender identity.  The report, which may be accessed here, was released on December 15 in response to the high number of reports of anti-gay human rights abuses flowing into the international body, according to the UN News Service.

In part, the report states, “The criminalization of private consensual homosexual acts violates an individual’s rights to privacy and to non-discrimination and constitutes a breach of international human rights law.”  Decrying violence against LGBT persons, the High Commissioner concludes that “Homophobic and transphobic violence has been recorded in all regions . . . Violence against LGBT persons tends to be especially vicious compared to other bias-motivated crimes.”  Data show that homophobic hate crimes often include “a high degree of cruelty and brutality.”

The hate crimes statistics in the report are horrific.  Lifting up the transgender and gender variant population, the High Commissioner reports, “The Trans Murder Monitoring project, which collects reports of murders of transgender persons in all regions, lists 680 murders in 50 countries during the period from 2008 to 2011.”  That said, the effort to collect data on murder and other acts of physical violence against LGBT people is complicated by the practice of nations around the world, either neglecting to collect these statistics, or outright refusing to allow their collection.

While over thirty nations have decriminalized homosexuality in the last two decades, 76 countries still make consensual acts between same-sex persons illegal, and at least five, Iran, Mauritania, Saudi Arabia, Sudan and Yemen, make homosexual conduct punishable by death.

The High Commissioner, Navi Pillay, calls upon the nations of the world to “Repeal laws used to criminalize individuals on grounds of homosexuality for engaging in consensual same-sex sexual conduct, and harmonize the age of consent for heterosexual and homosexual conduct; ensure that other criminal laws are not used to harass or detain people based on their sexuality or gender identity and expression, and abolish the death penalty for offences involving consensual sexual relations.”

Further, High Commissioner Pillay “calls on countries to ensure that no one fleeing persecution because of their sexual orientation or gender identity is returned to a territory where their life or freedom is at threat, and that asylum laws recognize that sexual orientation or gender identity is a valid basis for claiming persecution,” according to the UN News Service.  Ms. Pillay also recently held press conferences appealing to member nations to abolish homophobic bullying leading to the suicide of young LGBT people.

The report intensifies the call to member nations, issued last year by UN General Secretary Ban Ki-moon, to “reject discrimination in general, and in particular discrimination based on sexual orientation or gender identity.”

Ricky Martin, Latino Superstar, blasted politicians in his home commonwealth of Puerto Rico for seeking to remove gay people from legal protection from bias-motivated hate crimes, according to Fox News Latino. Martin posted a strong statement on his website blog denouncing the move.  In part, he said:

“I am very saddened by the turn the discussion on criminal law has taken in Puerto Rico that proposes to eliminate the aggravating in cases where crimes are committed by prejudice against the victim.”  Martin went on to say, “They ought to do their homework and review the Universal Declaration of Human Rights a bit…which says that everyone – all citizens – are equal before the law and have, without distinction, the right to equal protection under the law.”

Martin’s opposition to the change in Puerto Rico’s hate crimes law comes at a time when the numbers of anti-gay and transgender hate crimes are reaching epidemic proportions.  His voice will help amplify the protests of local LGBT and Dominican activists who are fighting the passage of the amendment in the legislature. In March 2010, Martin came out openly as a gay man, ending years of speculation by the public.  On his website, he said, “I am proud to say that I am a fortunate homosexual man. I am very blessed to be who I am.”  After years of  declining to comment on his sexual orientation, Martin said, “These years in silence and reflection made me stronger and reminded me that acceptance has to come from within, and that this kind of truth gives me the power to conquer emotions I didn’t even know existed.”   Now the father of two young sons , Matteo and Valentino, who were born of a surrogate mother in 2008, Martin took citizenship in Spain in 2011, where he intends to marry his lover.  Though he could be married in certain states in the U.S., he has said he wishes to marry in Spain to acknowledge the work of LGBT rights advocates and Prime Minister Zapatero there.

One of the motivators Martin says moved him to come out publicly as a gay man was the gruesome murder of Jorge Steven López Mercado in 2009.  The gay teen was abducted, dismembered, beheaded, and his remains were left burning along a rural road in central Puerto Rico.  The savagery of the killing awoke the consciences of many on the Island besides Martin, though the numbers of violent attacks against LGBT Puerto Ricans has continued to rise.  López Mercado’s murderer has been convicted, and is serving a 99-year sentence.

San Juan, Puerto Rico – Puerto Rico’s lawmakers are poised to remove LGBT people from hate crimes protection status with the stroke of a pen.  Although at least 18 LGBT Puerto Ricans have been murdered in hate crimes since 2009, Edge Boston reports that the territory’s Senate passed a bill last month removing LGBT people from protected categories under the hate crimes law that has been on the books since 2004. The exclusion effort now goes on to the House of Representatives for a vote this week in a special legislative session called by Gov. Luis Fortuño.

Outraged by the increasing number of anti-gay hate crimes, local LGBT activists demanded investigations in June.  The Advocate reports that the grisly murder and dismemberment of Jorge Steven López Mercado, a gay teen, ignited the protests that officials were not investigating anti-gay violence under the territory’s hate crimes law. Recently, the strangulation of gay Ezequiel Crespo Hernández, 22, on a public beach in Camuy, and a gas station assault on transgender woman Francheska González  so brutal that it punctured her breast implant, intensified the call for justice to be done. Three more LGBT Puerto Ricans, Alejandro Torres Torres, Karlota Gómez Sánchez and Ramón “Moncho” Salgado, were also found dead within a three-day period in June. ”It seems they have declared open hunting season against lesbian, gay, bisexual, transgender and transsexual people,”  Pedro Julio Serrano, founder of the gay rights group Puerto Rico for Everyone, said to the Associated Press. In response to rising criticism, Puerto Rico’s Attorney General directed an investigation into the application of the hate crimes law. Opponents of the LGBT community responded by quietly acting to remove queer folk from the penal code’s protection.

The penal code revision is drawing criticism from legislators and activists alike. The Advocate says Representative Héctor Ferrer and Sen. Eduardo Bhatia are among the most outspoken critics of the change. Ferrer, speaking at a press conference on Sunday, said,  “To eliminate these groups as protected categories is to invite the commission of hate crimes in Puerto Rico. It is a setback in the country’s public policy.” Bhatia added his voice, saying, “In an advanced society, this is dangerous for society.”  After the proposed amendment removing LGBTs from hate crimes protection, the only categories of persons who would be protected by the law in Puerto Rico would be political affiliation, age, and disability.

Activist Serrano told EDGE, ”Basically they took out the communities hardest hit by hate crimes in Puerto Rico out of the hate crimes statute,” Serrano told EDGE, referring the LGBT community and Dominicans who come to the island for work. “It’s an outrage and now we’re calling upon the House to restore this to where it should be.”  Protests and marches against the provision are planned this week throughout island. Serrano, referring to adversaries of the LGBT community, added, “They’re trying to do it under the radar and that’s how it went for a while. Under our watch, we’re not going to let this happen.”

Denton, Texas – For the second time in a history of delays and postponements, Richard Hernandez’s alleged murderer was ruled “incompetent to stand trial” on November 18 by a Denton County judge.  Seth Winder, 31, was ruled unable to assist in his own defense by District Judge Bruce McFarling after an examination finding him either unmedicated for his diagnosed mental impairment, or insufficiently dosed, according to the Crime Blog of the Dallas Morning News.  Winder exhibited nearly catatonic behavior during the third day of the trial–evidencing that he had received none of his prescribed drugs for his schizophrenia, or that he had been spitting out and hiding his nighttime dosages, perhaps for weeks before the trial began. No explanation was given for how Winder could have been considered fit for trial on November 16, but zombie-like two days later.  Neither was there an explanation of how jailers and med staff at the Denton County Jail could have so woefully neglected to make sure their smart-though-impaired inmate took his meds as directed and actually swallowed them.

Instead of completing the trial process for the gruesome murder and dismemberment of the openly gay Dallasite, Winder was sent to the North Texas State Hospital in Vernon for treatment.  The Dallas Observer speculates that Winder may not ever face trial again for the Silence-0f-the-Lambs-style butchery of  38-year-old Hernandez, whose body was never found–save for his internal organs left in the bathtub of his Far North Dallas apartment in September 2008.  This marks a second instance that Winder was found unfit to stand trial because of mental issues, the first being in May 2009.  Observer reporter Brantley Hargrove found legal opinion divided on whether the Colony resident will have another day in court.  Winder’s Defense Attorney, Derek Adame, says he seriously doubts another trial will take place. Denton County Assistant District Attorney Cary Piel, however, believes Winder will face judge and jury again, probably in April 2012.

Winder stands accused of murdering Hernandez in the gay man’s apartment, though the reasons for their relationship remain murky.  Both the Morning News and the Observer repeated the unproven allegation that the victim and his supposed killer were gay lovers.  Hernandez’s best friend, Rudy Araiza, has staunchly denied the possibility that Winder and Hernandez were ever “lovers,” and makes that point again in a blog response to the Dallas Morning News allegation. “Richard and Seth were ‘Never’ boyfriends!” Araiza said. “I’m not sure why this newspaper is making that statement, I knew Richard for 22 years, I would know!”  It may be another instance in which a grisly anti-gay hate crime is toned down for public consumption by partially blaming the victim for his own demise.  Media around the country have a notorious record for succumbing to this sensationalist temptation.  Investigators said they found pornographic pictures of Winder on the cell phone he lifted from the Hernandez apartment, though no proof has been offered of who took the images, or what they actually depict.

Although the murder weapon was never found, police did retrieve a sword stained with Hernandez’s blood in the tent where Winder was living. Detectives say that Winder used the sword to cut up the gay man’s body.  The dismembered parts of the victim were probably disposed of in a nearby dumpster, and then buried under tons of garbage in a landfill, making the body impossible to locate.  Winder’s use of Hernandez’s credit cards led police to arrest him.  Witnesses placed Winder in Hernandez’s apartment complex at or near the time of the gay man’s disappearance. Forensics found that the blood stains on Winder’s clothing and shoes were a genetic match to the victim.

So, Seth Winder, either crazy like a fox, or a neglected patient (or both), has avoided the jury again.  Meanwhile, Richard Hernandez, who in death cannot answer the innuendo against his character, receives no justice.  The eerie quiet throughout North Texas surrounding this latest trial development in one of the most heinous crime cases in Dallas history seems to confirm  that many have an investment in hushing the whole thing up. Which would not be the first time such a thing has happened in Texas when it comes to violence against the LGBTQ community.

Toledo, Ohio – An ordained gay Baptist minister has called upon churches to change their anti-gay attitudes and language.  Dallas Baptist preacher and theologian, Dr. Stephen Sprinkle, speaking to a packed house at the University of Toledo last month, said that the notion Christianity and the Bible are considered irreconcilably anti-gay by many in contemporary churches is simply wrong. Citing Dr. Peter Gomes, the late chaplain of Harvard, Sprinkle said that the biblical teachings on hospitality to those who have been deliberately excluded by society, ”the poor, the discriminated against, people of color, women, homosexuals, and all persons beyond the conventional definition of Western civilization,” is far more significant than the few misinterpreted Bible texts used to condemn LGBTQ people.  Sprinkle went on to note that Christianity arose in the cosmopolitan world of the Greeks and the Romans, who in the main were tolerant of same-gender-loving people for much of the classical age.  When taken as a whole, the early churches exhibited very little concern about what we today call “homosexuality.”  “Homosexuality,” Sprinkle said, “is not mentioned in the Top Ten [Commandments], and is not in the message of any of the Prophets.”

The Republic reports that Sprinkle was invited to speak at a rally sponsored by Equality Toledo in response to the so-called “billboard wars” over LGBTQ acceptance in the Toledo church community.  A progressive United Methodist congregation put up a large billboard on a well-traveled street in April proclaiming that “Gays Are a Gift From God.”  An evangelical mega church responded by buying up space on nine huge billboards around the city rebutting the Methodist claim with the slogan “Gays Are NOT a Gift From God.”  Sprinkle, a professor at Brite Divinity School in Fort Worth, and Theologian in Residence at Cathedral of Hope United Church of Christ, the largest LGBTQ predominant congregation in the world located in Dallas, is a widely-sought speaker and teacher.  His most recent book, Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims (Resource Publications, 2011), is an anthology of stories of people murdered for their sexual orientation and gender identity, most of whom were killed by people who claimed justification from the Bible and church teachings. He is the founder of the Unfinished Lives Project, and the web master of http://unfinishedlivesblog.com, a blog seeking to remember the victims of hate crimes violence in the United States.

Brandon McInerney executed his gay classmate in February 2008.

Ventura County, California – The teen killer of a gay classmate has pleaded guilty second-degree murder.  Brandon McInerney, 17, 14-years-old at the time he pulled the trigger, shot gay 15-year-old Larry King in the back of the head execution-style at E.O Green Middle School in Oxnard, California in February 2008 before the eyes of his first-period classmates.  The facts of the case are undisputed.  Rising behind his victim, McInerney pumped two rounds into the back of Larry King’s skull, fulfilling a threat he made to a girlfriend at school the day before.  McInerney will receive a 21-year sentence for a crime that many say bears all the hallmarks of a pre-meditated, first-degree hate crime murder.

In September of this year, a mistrial was declared after two months of testimony, due to the inability of the jury to come to a decision about the guilt of young McInerney.  Prosecutors had argued for first-degree murder, based on the established pre-meditation and the heinous nature of the crime.  Under California law, a 14-year-old may be tried as an adult, and McInerney, who confessed to the murder seemed to fit the statute’s requirements. Prosecutors claimed that because of McInerney’s antipathy toward King’s sexual orientation and gender expression, and because of white supremacist loyalties the killer clearly embraced, the murder was a clear-cut case of anti-LGBT hate crime.  Defense turned the tables on the prosecution, putting the dead victim on trial instead of their client.  They resurrected the infamous “gay panic/trans panic” defense, drumming their contention into the jurors’ minds that King was the prime aggressor, pressing his flamboyant sexuality toward McInerney until he “snapped.”  Enough of the jury bought the ploy that the jury hung. Had the first-degree charge been upheld, the defendant would have received 53 years for his crime.

The Advocate reports that formal sentencing will take place for McInerney on December 19. Twenty-one years in prison is a long time for McInerney to consider that every day he lives is another he stole from a gay classmate because of his discomfort with a person who was different. For the LGBTQ community, the specter of the “gay panic defense,” like a hungry ghost, lingers on, given new energy by this plea deal.

Dallas, Texas – After three years of delays and postponements, the trial of the accused murderer of openly gay Richard Hernandez begins today.  The Dallas Voice, doing great journalistic work on this difficult case, announced the story on November 10, quoting first assistant Denton County district attorney Jamie Beck on the trial delays, “Everybody wants a swifter and quicker justice, but you’ve got to do it right. Bottom line, we want justice, so if that means it takes a while, then so be it.”

The “Silence of the Lambs” style murder of 38-year-old Hernandez, an employee of Walmart, drew national press attention in September 2008 when the victim’s viscera but no body was discovered in an apartment in far North Dallas.  When Hernandez, a conscientious employee, did not report for work, his friends prevailed on the apartment superintendent to open his residence, and what they found resembled a slaughterhouse.  Copious amounts of blood spattered the walls.  Hernandez’s body was never found, but tissue from it was left, dumped in the bathtub.  Dallas Police acted quickly to track down the killer. True Crime reported that the DPD filed capital murder charges against Seth Winder, 29, a homeless man with a history of erratic behavior and mental illness, even though they did not have possession of a body in the case–only the third time in thirty years of police department history.

Winder was located because of credit card charges he made to Hernandez’s stolen cards after the murder date.  Police apprehended Winder in a tent inThe Colony, where he was in possession of personal items of the victim and a bloody sword that may have been used in the dismemberment.  The Dallas Voice reports the police conclusion that the killer disposed of the body in a trash dumpster which was emptied in a landfill, making Hernandez’s remains unrecoverable.

Winder’s competence to stand trial was hotly contested in the earlier days of the case.  His father and stepmother told the press that their son was a schizophrenic who had once tried to strangle his own mother.  Friends of Hernandez contended that Winder was just clever enough to play ill in order to avoid responsibility for the grisly murder.  The whole stew was made nastier by the report of police investigators that they discovered a digital camera belonging to Hernandez with “pornographic images” of Winder. The victim’s friends and family vigorously denied the implication that Hernandez and Winder were in a sexual relationship. In the end, Winder was ruled incompetent to stand trial.

Hernandez’s mother will not be there today to see if justice will be done for her son.  She died with the story unresolved, thanks in part to a strategy of delays put in place by Winder’s legal defense team, and to the untimely publication of a book on the murder authored by Winder’s own stepmother.

Now, after years of treatment, authorities say Seth Winder is able to face his day in court.  Jury selection has begun, and barring other delays, three years of agonized waiting are about to conclude for Richard Hernandez’s friends and remaining family.

Detroit, Michigan – The charred torso of a missing teen transwoman of color was identified this week in the Wayne County morgue where it had been stored for weeks, and left unidentified.  The remains were collected near Interstate 94 on Detroit’s east side.  Michele “Shelley” Hilliard, 19, was last seen on October 23 at 1:20 a.m., and was reported missing, according to the Detroit Free Press.  Though her facial features and fingerprints were destroyed by fire, investigators were able to make a positive identification because of a distinctive tattoo depicting cherries inked into her upper right arm.  Her mother, summoned by the Wayne County Examiners Office, also confirmed the identity of her child from the tattoo on the burnt remains. Police are now investigating Ms. Hilliard’s death as a homicide.  There is no word about whether a transphobic hate crime is suspected by the authorities, but the disappearance coupled with the attempted immolation of the remains is a familiar signature of anti-trans hate crimes.  Equality Michigan is aiding the Detroit Police Department in their investigation, according to CBS Detroit.  Michigan’s hate crimes law does not include LGBTQ persons as protected classes, making it harder to compel law enforcement to regard violence against the queer community as hate crimes.

In little more than two weeks, three gay men, Steven Iorio from Pennsylvania, Burke Burnett of Texas, and Stuart Walker from Scotland were either attacked by homophobes wielding fire as a weapon, or had their remains immolated after death. Now the immolated remains of transgender Shelley Hilliard are discovered on a Detroit Interstate service road, raising the question of how often fire is employed as a weapon of transphobic/homophobic terror.  As Philip M. Miner of the Center for Homicide Research points out for the Huffington Post, while between 600 and 700 people are killed by arson every year in the United States, fully 26 per cent of this total is from the gay and transgender community.  Miner observes that the use of fire and arson as hate crimes weapons against the LGBTQ community is normally thoroughly planned out ahead of time. He writes: “Attacks involving arson are especially brutal. Meticulous care is taken in carrying them out. The violence is heaped on . . . [Anti-LGBTQ arson attacks] are wrought with meaning,” Miner continues. “The offender wants there to be no doubt that this violence was intentional. In the case of hate crimes, it’s a warning. This is what happens when you are gay. This is what these people get — what they deserve.” 

Equality Michigan points out in its report on transgender hate violence, “During the first half of 2011, Equality Michigan received reports of 83 incidents of violence or intimidation targeting gay and transgender residents that are considered hate crimes under the [federal] Shepard-Byrd Act. However, because the statewide hate crime law is not comprehensive, incidents against gay and transgender Michiganders that are clearly motivated by anti-gay or anti-transgender bias are ignored as hate crimes.”  As a case in point, advocates are watching the Hilliard case especially closely.

Michele “Shelley” Hilliard was nicknamed “Treasure.” The irony of her murder, a young transwoman who had courage enough to transition into the authentic person she truly was, is that only now do we begin to understand the treasure we have lost in her passing.

Anti-LGBTQ Activist Scott Lively

Springfield, Massachusetts – In an example of the worst religion-based bigotry of this generation, a longtime promoter of violent rhetoric against the LGBTQ community published an open letter claiming to love gay people with a message of hate.  Scott Lively, founder of Abiding Truth Ministries in Springfield, Massachusetts, has targeted gays and lesbians for criminalization on three continents, and is on the Montgomery, Alabama Southern Poverty Law Center’s list of Hate Groups.  The SPLC in its “Hatewatch: Keeping an Eye on the Radical Right” bulletin reports that Lively posted an RSVP letter to “LGBTs” on his DefendtheFamily.com website on Monday. Lively says he “loves” gays, but they are all bound for hell, and need help.

As the SPLC notes, Lively has worked feverishly for three decades to defame and outlaw gays and lesbians in his speaking and publishing.  His only work of note is The Pink Swastika, a thoroughly discredited screed in which Lively contends that the Nazi movement was a homosexual plot.  By implication, Lively accuses LGBTQ people of instigating World War II and the execution of untold millions. While no reputable historian credits a thing he says, right wing Slavic Christian extremists have promoted the book throughout the old Soviet Bloc and beyond.  Lively has been influential in the Watchmen On the Walls ministries, which has calls gays and lesbians a disease that requires an “divine penicillin” and expressions of “muscular Christianity” to cure.  He is one of the prime advocates of reparative therapy in sub-Saharan Africa.  In Uganda, Lively testified before lawmakers as the infamous “Kill the Gays” bill was making its way through Parliament.  Now that the Ugandan government is reconsidering the stalled bill, which makes homosexual activity punishable by death, Lively’s pseudo-science and religious distortions will come into play again, urging state-sanctioned violence and oppression against LGBTQ people.

In this country, Lively excused the hate crime murder of gay immigrant Satendar Singh by Slavic Christian fundamentalists in Sacramento.  Singh’s murder heightened tensions between the LGBTQ community and Russian and Slavic fundamentalist churches, as reported at chapter length in the recent book by Dr. Stephen Sprinkle, Unfinished Lives. In effect, Lively has declared war on the LGBTQ community  time and time again. In a letter to the Washington Times on June 23, 2003, Lively wrote: “No clear-thinking person believes that the homosexual sexual ethic and that of the family-based society can peacefully coexist. …One must prevail at the expense of the other.”  At a Russian conference in Novosibirsk in August 2007, Lively’s violent metaphors came out in the open: “There is a war that is going on in the world. There is a war that is waging across the entire face of the globe. It’s been waging in the United States for decades, and it’s been waging in Europe for decades. It’s a war between Christians and homosexuals.”

In Lively’s RSVP letter to the LGBT community, though he changes his tone, there is no reason to believe he has moderated any of his virulent, anti-gay intentions for outlawing and criminalizing people based on their sexual orientation and gender variant identity.  He claims that God gave him a “Word” in March to speak directly to the gay community.  He writes to LGBTQ people: “I am appealing to you to begin to agree with God about homosexual sin, and to turn away from the seductive lie that God approves of homosexuality and wants you to embrace a homosexual identity . . . You must repent to be saved.”  Lively particularly singles out Open and Affirming Churches, which welcome LGBTQ people and celebrate their lives and loves, and reduces Christian faith to a condemnation of anyone who deviates from Lively’s norms.  Lively also condemns any attempt from the gay and lesbian community to do theology at odds with his own: “’Gay theology’ turns the logic of the Bible on its head, and tries to make the sinner “good enough” to earn heaven . . . This is a dangerous lie that leads straight to hell.”  The solution for LGBTQ people is to rush to Exodus International for anti-gay aversion brainwashing.

In an astonishing attempt to prey upon LGBTQ people who suffer from internalized homophobia, he finishes his letter with a simpering self-justification: “In publishing this letter I know that I will be subjecting myself to ridicule, abuse and hatred. You know very well how nasty some of your peers can be. Yet I am doing it anyway, because in Jesus I love you and I want you to be saved . . . Frankly, as I sit here at my computer, I wonder whether my entire career against your political and social agenda, and all of the notoriety I have achieve in your community might all have occurred so that I would be a person whose letter you would read today.”

Scott Lively is an example of the worst religious bigotry active in America today.  SPLC’s Ryan Lenz writes that Lively began his career in bigotry in 1992 seeking to classify homosexuality on a par with pedophilia and sadomasochism.  He has not changed, nor are his motives ever to be trusted.  Ask Satendar Singh’s family.

Laramie, Wyoming – Wednesday, October 12 will be the thirteenth anniversary of America’s archetypal gay hate crimes victim.  Matthew Shepard was brutally attacked and beaten into a coma by two locals who targeted him for abduction, robbery, and murder at the Fireside Lounge on the night of October 7, 1998.  They left him trussed to the base of a buck fence, exposed to the freezing cold after stealing his shoes.  When Matt was discovered the next day by a passing mountain biker, he was so brutally disfigured that his discoverer at first assumed what he was looking at was a broken down scarecrow that had been put out for Hallowe’en.  Matt’s injuries were too severe to be treated at the local hospital emergency room, so he was transported to Fort Collins in neighboring Colorado where a state of the art trauma center fought to save his life.  For five agonizing days, Matt lay close to death with an injured brain stem–a terrible wound from which he could never recover.  His family, mother Judy, father Dennis, and younger brother Logan stood vigil beside him while the life force ebbed.

For thirteen years, Matt’s memory has been honored, invoked, and ridiculed by a nation wrestling with heterosexism, homophobia, and transphobia–a culture of anti-LGBTQ violence that has claimed the lives of over 13,000 queer folk whom we know about (and God knows how many others whose murders have never been reported to anyone keeping records).  Nothing will ever bring any of them back to us.  They are gone, but to memory.

Those of us who labor for the better angels of our national character to emerge have a responsibility to remember Matt and all the rest, to honor them by never forgetting the cost of being sexually different in these United States, and to take up the mission of educating the LGBTQ community and the general public that difference of any kind is no warrant for ignorance,prejudice, and violence, but rather is an occasion for understanding and neighborly solidarity.  The anniversary of Matt’s untimely death is a good time to erase hatred from the American psyche.

In that spirit, I offer this short excerpt from “The Second Death of Matthew Shepard,” Chapter One of my recently published book, Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims:

“Matt Shepard died in a Fort Collins, Colorado hospital in the wee hours of October 12, 1998 with his parents by his side. Ironically, it was the day after America’s observance of National Coming Out Day. His team of doctors and nurses, professional as they were, could not undo what hate had done to Matt.  He never woke up from his coma. His heart gave out. The ventilator switched off, and Matt was gone. Our memory of him,however, cannot rest in peace. Not yet” (page 3).

Our memory of all the dead whose “unfinished lives” calls out to us to do the work of justice.  May Matt and the 13,000 rest in peace. God being our strength, we must not.  Grace and peace to all on this National Coming Out Day 2011.  ~ Stephen V. Sprinkle

Brandon McInerney to be retried for the murder of gay classmate, Larry King

Ventura County, California – Prosecutors announced on Wednesday they would retry teen Brandon McInerney for the execution-style murder of his gay classmate, Lawrence Fobes “Larry” King in adult court.  This time, however, all hate crimes charges are being dropped.  Maeve Fox, chief prosecutor in the case, said that the trial would begin on November 21 in Ventura County Superior Court. KABC in Los Angeles reports that defense attorneys for McInterney hope the case will be settled by plea bargain before the trial begins.

A mistrial was declared on September 2 when the nine-woman, three man jury in Chatsworth could not agree on a verdict.  Some jurors have contended that McInerney, who was 14 at the time of the shooting, should never have been tried as an adult.  They also have said they were not convinced by the prosecution that white supremacist, anti-gay prejudice led McInerney to kill his gender variant classmate, whom McInerney knew as “the little fag.”  The defense successfully used a version of the outworn “gay panic defense” to switch sympathies of the jury and the public in the case, putting Larry King’s dress and habits on trial at least as much as the criminal act of their client, the brutal in-class shooting.  Defense has consistently denied using the gay panic defense, and just has consistently employed it to insinuate that their client’s actions were mitigated by the intimidation he felt coming from a smaller, bullied gay teen.

In order to get a conviction, the prosecution has deleted all hate crimes charges, raising the ire of LGBTQ rights advocates around the nation.  Once again, a courtroom in Southern California will be the arena for the validity of the gay panic defense in the most notorious anti-gay hate crime since the murder of Matthew Shepard in 1998.

Lawrence Russell Brewer, on the day he was booked for the murder of James Byrd Jr.

Huntsville, Texas – On September 21 at 6:11 p.m., before witnesses whom included his hate crime victim’s family and his own, Lawrence Russell Brewer, 44, was injected with lethal drugs in the execution chamber of Huntsville Prison.  Ten minutes later, he was pronounced dead.  Sentenced to death for the 1998 dragging murder of James Byrd Jr., there was no doubt about the convict’s guilt.  Brewer and two accomplices, John William King and Shawn Allen Berry, abducted Byrd, a 49-year-old African American, in Jasper, Texas, beat him, bound him with a log chain attached to the backend of a pickup truck, and dragged him three miles down a rough East Texas road until his head was detached from his body when it hit a culvert.  The racially-motivated murder made the nation shudder–and marked a decisive moment in the hate crime justice movement for LGBTQ people as well as for African Americans. But the justice of capital punishment for hate crime murders is still up for serious question, even after the execution of a bigoted man who displayed no remorse for his crime.  Brewer had even urinated on Byrd before dragging him to his death.

In Texas, the racist murder of James Byrd Jr. was quickly equated with the anti-gay murder of young Matthew Wayne Shepard in Laramie, Wyoming, that occurred barely four months later.  After abortive attempts to get a state hate crimes statute naming gays and lesbians as a protected class, the Byrd family agreed to sign on with Shepard’s family to achieve a landmark Texas law including African Americans and LGB persons as protected classes from prejudicial murder.  Governor Rick Perry, who today is the notably anti-gay Republican front runner for President, signed the James Byrd Jr. Hate Crimes Act into law back in May 2001, inclusive of “sexual preference” as a protected category.  It took the federal government eight more years to enact a comprehensive hate crimes law inclusive of LGBT people in the United States. The James Byrd Jr. and Matthew Shepard Hate Crimes Prevention Act, also known as the Matthew Shepard Act, was signed into law by President Obama in October 2009.  The families of Matthew Shepard and James Byrd Jr. were honored guests at the presidential signing ceremony in the White House.

Can state-sanctioned execution remedy anti-gay or racially motivated hate crime murders?  Brewer’s death by lethal injection, in the same week as the hotly contested execution of Troy Davis in Georgia, brought that issue to a head for the national media, human and civil rights activists, moral theologians, and the families of victims alike.  Lawrence O’Donnell, MSNBC anchor of “The Last Word,” opined that the only way to prevent the execution of putatively innocent death row inmates like Davis is to outlaw the execution of even the most unrepentant of guilty killers like Brewer.  Dick Gregory, the fabled comedian and human rights activist, was present in Huntsville protesting the execution of James Byrd Jr.’s murderer for just that reason.  The Houston Chronicle quotes Gregory as saying, “Any state killing is wrong. If Adolph Hitler were to be executed,” he said, “I would be here to protest . . . I believe life in prison is punishment. Execution is revenge.”

Ross Byrd, James Byrd’s son, who is now 32, spoke out to Reuters the night before Brewer’s execution for the murder of his father. “You can’t fight murder with murder,” Byrd said, representing his family. “Life in prison would have been fine. I know he can’t hurt my daddy anymore. I wish the state would take in mind that this isn’t what we want.”  The Reuters article concludes by presenting Ross Byrd’s position that for the state to execute Brewer is no more that a continuation of the cycle of violence that destroyed his father’s life on that lonely road in the dead of night in 1998. Byrd believes that all people, the government included, should decide not to perpetuate that cycle of death. “Everybody’s in that position,” he said. “And I hope they will stand back and look at it before they go down that road of hate. Like Ghandi said, an eye for an eye, and the whole world will go blind.”

Dennis Shepard, Matthew Shepard’s father, took a similar position on the day his son’s second killer was sentenced to two consecutive life terms in prison.  Speaking to Aaron James McKinney, the roofer who beat Matt into a fatal coma with a pistol, Shepard said that Matt was not opposed to the death penalty. As a matter of fact, at a family meeting, Matt had said that heinous murders like the dragging death of James Byrd Jr. deserved capital punishment. “Mr. McKinney,” Shepard said, “I, too, believe in the death penalty. I would like nothing better than to see you die, Mr. McKinney. However, this is the time to begin the healing process. To show mercy to someone who refused to show any mercy. To use this as the first step in my own closure about losing Matt. Mr. McKinney, I am not doing this because of your family. I am definitely not doing this because of the crass and unwarranted pressures put on by the religious community. If anything, that hardens my resolve to see you die. Mr. McKinney, I’m going to grant you life, as hard as that is for me to do, because of Matthew.”  Shepard concluded, “Mr. McKinney, I give you life in the memory of one who no longer lives. May you have a long life, and may you thank Matthew every day for it.”

Admittedly, all other hate crimes victims’ families do not necessarily agree with Mr. Byrd and Mr. Shepard.  Some support capital punishment as justice for the heinous nature of the crimes committed against their loved ones.  But Lawrence Russell Brewer’s Texas execution is not so cut and dried as the most ardent supporters of capital punishment would like to believe.  The world is far grayer than any black-and-white wishes for closure can achieve in a culture where bigotry kills innocent people everyday, and where the state can and does execute anyone it deems legal to terminate. What is right and what is wrong about capital punishment for hate crimes murder perpetrators?  What is just for the victims and their families, and for the society the killers have also grievously wounded by their deeds of hatred?  We at the Unfinished Lives Project do not claim to have the final truth about these monumental issues.  But we do agree with Ross Byrd and Dennis Shepard.  Until our fallible knowledge is replaced by the divine in some other world than this and some other time than ours, we will err on the side of mercy.  Honor the dead.  Break the cycle.  Stop the killing.

Newark, New Jersey – A 36-year-old harasser in Essex County found out the hard way that attacking gay people is costly–to himself!  Douglas Brown started harassing his former gay neighbors in the Ironbound section of Newark back in May–chanting slurs and epithets, spewing hate speech.  Unsatisfied with the results, Brown escalated his aggression against the couple, pouring oil on their home, destroying their property, and eventually slashing their car tires.  Brown was arrested on Thursday, and faces harassment, bias intimidation, and criminal mischief charges, according to reports by the Associated Press, The Advocate, and NBC New York.  Brown obviously never counted the cost of his bias against his next door neighbors, acting on it with abandon until his arrest.  He is being held under $25,000 bond at the Essex County Correctional Facility.  Acting Essex County Prosecutor Carolyn Murray is preparing to prosecute Brown for anti-gay hate crime.  There is no information yet about who Brown’s attorney will be.  In the Brick City, once notorious for the 2003 hate murder of lesbian teen Sakia LaTona Gunn, the times appear to be a-changing.  Attacking gay people in Newark will now get you prosecuted to the full extent of the law.

The insults, rumors, and ridicule became too much for Jamey to bear.  On a Formspring site he opened to chat with friends online, he was targeted by irrational hate.  The Washington Post reports two representative instances of hate speech that would have unsettled anyone, no matter how well grounded: “JAMIE IS STUPID, GAY, FAT ANND UGLY. HE MUST DIE!” an anonymous detractor wrote. Another went straight for his heart: “I wouldn’t care if you died. No one would. So just do it It would make everyone WAY more happier!”  Even though there were expressions of support among the posts to his site, the loudness of the hate drowned out the love. In hindsight, Jamey’s cries for help are all too obvious.  On September 9, he wrote on Facebook, “I always say how bullied I am, but no one listens. … What do I have to do so people will listen to me? No one in my school cares about preventing suicide, while you’re the ones calling me [gay slur] and tearing me down.”  But the face he let his parents see was calm and relatively upbeat.  Just days before he took his own life, the family went on a camping trip.

Amherst Police are investigating whether charges may be brought against youths who continually dogged Rodenmeyer with taunts and slurs. Buffalo News reports that the Special Victims Unit has been assigned to investigate whether crimes were committed against Jamey.  Cyberbullying, especially if it was centered on Rodenmeyer’s sexual orientation, could carry charges against his tormentors.  Police spokesmen have said that they are focusing their probe on one to three young harassers who targeted Rodenmeyer ever since he was a student at Heim Middle School. “We’re looking into it to see if he was the victim of any crimes, and that’s the bottom line,” Amherst Chief of Police John C. Askey told reporters. “We’re going to be speaking to school officials and students and anyone with direct information about crimes that may have been committed against this individual.”

Nearly 5,000 youths commit suicide each year, according the Centers for Disease Control, making teen suicide, especially teen LGBTQ suicide, a national health issue.  But the statistics cannot adequately count the cost of bullying in American society. Criminal harassment, ridicule, and threats strike real boys and girls one-by-one, like Jamey Rodenmeyer, and rip away their futures. In the last communication of his short life, Jamey tweeted Lady Gaga, “@ladygaga bye mother monster thank you for all you have done, paws up forever.”  In a tribute to Gaga, Jamey’s parents buried him Saturday wearing his “Born This Way” tee shirt.
