Brandon McInerney pled guilty to the execution-style murder of his gay teen classmate, Larry Fobes King.

Ventura County, California – Prosecutors in the Brandon McInerney murder trail agreed to a plea deal rather than take young gay Larry King’s confessed killer into court a second time, according to EDGE Boston.  McInerney, 14 at the time he shot his 15-year-old gay classmate in the back of the skull in his middle school computer class in 2008, will be sentenced today.

The Ventura County District Attorney’s Office agreed to a deal because they couldn’t be sure what would happen if they put McInerney back on trial again.

McInerney’s defense team succeeded in putting King on trial for his own murder, at least enough so that the jury in the first trial could not agree on a verdict, and a mistrial was declared.  While legal experts saw the case as a clear-cut instance of pre-meditated murder, the prosecutors for Ventura County could not surmount the sympathy factor for the 14-year-old, and the discomfort factor in the way the press and the defense portrayed King.  Instead of the forthright homophobic murder the prosecution sought, a combination of child-nostalgia and anti-transgender and anti-gay bias turned King into a “Franken-Larry,” a devious, dangerous homosexual predator–a portrayal that could not have been further from the truth about the real boy who was in transition from a scared, bullied gay school kid to a youth who could affirm and live out his gender variance.

Media distortion in the King case started as early as the first reports about the murder, with sensational accounts of what young King wore to school, and his responses to McInerney’s bullying.  Ramin Satoodeh, reporter for Newsweek, wrote a cover story on King that was devastating–likening the boy to a monstrous little predator, tottering after his love interests in platform heels.  McInerney’s defense lawyers countered prosecution evidence of his Neo-Nazi and white supremacist motives by casting King, who was smaller and weaker than McInerney, as the aggressor, and skillfully used the press to drive this point home.  The California law making a 14-year-old prosecutable as an adult in heinous cases using firearms (which this case was in both particulars) was also put on trial in the media.

In the end, justice for Larry King was not the goal of a chastised district attorney’s office.  Assistant DA Mike Frawley said that they “took into consideration the time [McInerney would have to spend] in jail to protect the community.”  McInerney’s murder conviction has been stayed, and he will be sentenced to 11 years for voluntary manslaugher, and 10 years for the use of a firearm. With the four years he has already served in jail, McInerney will serve 25 years total.  Had the first-degree murder conviction been impose, he would have served 51 years.  Now, the confessed murderer of a young gay boy will be out on the street by his 39th birthday, and the dubious “gay panic defense” receives new life in the American legal system.

Denton, Texas – For the second time in a history of delays and postponements, Richard Hernandez’s alleged murderer was ruled “incompetent to stand trial” on November 18 by a Denton County judge.  Seth Winder, 31, was ruled unable to assist in his own defense by District Judge Bruce McFarling after an examination finding him either unmedicated for his diagnosed mental impairment, or insufficiently dosed, according to the Crime Blog of the Dallas Morning News.  Winder exhibited nearly catatonic behavior during the third day of the trial–evidencing that he had received none of his prescribed drugs for his schizophrenia, or that he had been spitting out and hiding his nighttime dosages, perhaps for weeks before the trial began. No explanation was given for how Winder could have been considered fit for trial on November 16, but zombie-like two days later.  Neither was there an explanation of how jailers and med staff at the Denton County Jail could have so woefully neglected to make sure their smart-though-impaired inmate took his meds as directed and actually swallowed them.

Instead of completing the trial process for the gruesome murder and dismemberment of the openly gay Dallasite, Winder was sent to the North Texas State Hospital in Vernon for treatment.  The Dallas Observer speculates that Winder may not ever face trial again for the Silence-0f-the-Lambs-style butchery of  38-year-old Hernandez, whose body was never found–save for his internal organs left in the bathtub of his Far North Dallas apartment in September 2008.  This marks a second instance that Winder was found unfit to stand trial because of mental issues, the first being in May 2009.  Observer reporter Brantley Hargrove found legal opinion divided on whether the Colony resident will have another day in court.  Winder’s Defense Attorney, Derek Adame, says he seriously doubts another trial will take place. Denton County Assistant District Attorney Cary Piel, however, believes Winder will face judge and jury again, probably in April 2012.

Winder stands accused of murdering Hernandez in the gay man’s apartment, though the reasons for their relationship remain murky.  Both the Morning News and the Observer repeated the unproven allegation that the victim and his supposed killer were gay lovers.  Hernandez’s best friend, Rudy Araiza, has staunchly denied the possibility that Winder and Hernandez were ever “lovers,” and makes that point again in a blog response to the Dallas Morning News allegation. “Richard and Seth were ‘Never’ boyfriends!” Araiza said. “I’m not sure why this newspaper is making that statement, I knew Richard for 22 years, I would know!”  It may be another instance in which a grisly anti-gay hate crime is toned down for public consumption by partially blaming the victim for his own demise.  Media around the country have a notorious record for succumbing to this sensationalist temptation.  Investigators said they found pornographic pictures of Winder on the cell phone he lifted from the Hernandez apartment, though no proof has been offered of who took the images, or what they actually depict.

Although the murder weapon was never found, police did retrieve a sword stained with Hernandez’s blood in the tent where Winder was living. Detectives say that Winder used the sword to cut up the gay man’s body.  The dismembered parts of the victim were probably disposed of in a nearby dumpster, and then buried under tons of garbage in a landfill, making the body impossible to locate.  Winder’s use of Hernandez’s credit cards led police to arrest him.  Witnesses placed Winder in Hernandez’s apartment complex at or near the time of the gay man’s disappearance. Forensics found that the blood stains on Winder’s clothing and shoes were a genetic match to the victim.

So, Seth Winder, either crazy like a fox, or a neglected patient (or both), has avoided the jury again.  Meanwhile, Richard Hernandez, who in death cannot answer the innuendo against his character, receives no justice.  The eerie quiet throughout North Texas surrounding this latest trial development in one of the most heinous crime cases in Dallas history seems to confirm  that many have an investment in hushing the whole thing up. Which would not be the first time such a thing has happened in Texas when it comes to violence against the LGBTQ community.

Dallas, Texas – Gay Republican consultant Taylor Garrett was decked with a hard blow to the left eye last week, according to various press reports.  A cast member on the gay reality television show, LOGO’s “A-List Dallas,” Garrett is closely associated with high-profile human rights opponent, Ann Coulter.  Returning to his car from a birthday party on the entertainment strip along Cedar Springs Road in Dallas, Garrett says he was shocked to find the words, “F-ck Coulter,” keyed into his car door.  A large man appeared out of the shadows where he was squatting, and knocked Garrett to the ground, cutting his brow and bloodying him.  He also fell on broken glass beside the car, scraping his body.

Garrett is convinced gay Democrats are behind the bias against him and other gay “conservative Republican Christians.”  In an interview with the Daily Caller, he said, “I would’ve thought people would have been a little more tolerant considering that our community advocates for tolerance, but it has been nothing but mean spirited attacks, especially after the Ann Coulter scene,” referring to his well-publicized luncheon recently with Coulter.  Using racist plantation language, Garrett said that gay Democrats want him to “stay on the plantation,” but he is having none of it. Shaken by the incident, he says another season for him on the popular LOGO series is in doubt.

An ambulance was called to the scene, but the paramedics did not elect to transport him to the hospital, since his injuries did not warrant it. Some members of the LGBTQ community and media have suggested that Garrett is using this incident and another in October when a rock was thrown through his window to gin up publicity for himself.  Garrett denies the allegations. Dallas Police have not designated the assault as a hate crime at this point.

In an exclusive interview with Huffington Post, Garrett continued the theme of gay hypocrisy over politics.  “This goes to show you,” he said, “that the gay community advocates for diversity and is against bullying, but in our own community we discriminate based upon if you’re a Democrat or a Republican or if you don’t necessarily fit within the mold of the political views of the gay community.”

Toldeo, Ohio – A packed auditorium heard an out gay Baptist scholar from Texas challenge the Toledo Christian Community and the LGBTQ and Allied Community of Northwest Ohio to move toward reconciliation on Monday night.  Dr. Stephen Sprinkle of Brite Divinity School, and Theologian in Residence of Cathedral of Hope, Dallas, the world’s largest LGBTQ predominant congregation in the world, spoke on “Born This Way: Why faith communities are welcoming LGBTQ people.”  Dr. Sprinkle is the founder of http://unfinishedlivesblog.com and the Unfinished Lives Project which seeks to tell the stories of hate crimes victims in the United States. A coalition of progressive Christians and Muslims, as well as Equality Toledo responded to homophobic signs posted around Toledo by a mega church in Maumee pastored by a well-known detractor of the LGBTQ community.  In April 2011, a small open and affirming United Methodist Church collected money enough to put up a large billboard proclaiming, “Gay Is A Gift From God.” The purpose according to the leadership of Central United Methodist Church was to start a conversation in Toledo about healing and inclusion at a time of dire economic crisis and social stress.  Then, in September, the 2,500 member Church on Strayer, pastored by Evangelist Tony Scott, decided to bombard Toledo with nine billboards countering, “Gay is NOT a Gift from God,”  with the word “NOT” in scare-caps and blazing red.  Adweek called this “a church ad battle over God and Gays.” The Toledo Blade reported that Scott believes sexual orientation is a choice, and an evil one.  But Central UMC’s members were not discouraged by the homophobic mega church attacks. Lynn Braun, chair of the Methodist Church’s lead team said to the Blade: “I’m somewhat surprised it didn’t happen earlier. We felt it important to express our faith this way. I think people have the right to express their faith the way they see fit, and I think it helps the community to know where churches stand.”

In a bold move, progressives reached out this week with a positive response to the attacks.  Fox News Toledo led its evening news with the story, “Controversial Billboards Spur Positive Response.”  Fox interviewed Rev. Cheri Holdridge, pastor of the Village Church in Toledo, and one of the organizers of the University of Toledo event.  She countered the homophobia with an affirming message of God’s love.  “Two churches put billboards up and one particular church feels that it is the word of God that gay people are not welcome in churches,” Holdridge said to Fox News. “We wanted to be clear to the people of Toledo that there are many churches that do welcome gay people and that we don’t believe it is a sin to be gay.” Dr. Stephen Sprinkle, an openly gay faculty member at Texas Christian University’s Brite Divinity School told Fox, ”There is a spiritual movement afoot that includes everyone. Including LGBTQ people. There are literally hundreds of thousands of faithful people who are gay or lesbian or transgenders, who have come out in their congregations’ lives and we’re not going back in the closet again,” Dr. Sprinkle went on to say. “Because of that, then, there is a conversation about what the role of faith communities needs to be towards us.” Joni Christian, a member of the United Church of Christ who attended the event at UT, said she was thankful for the message of truth and reconciliation at the meeting.  Speaking to Dr. Sprinkle, she said, “Thank you for your message in Toledo. You brought it in such a way that we should remember WWJD (What Would Jesus Do).”

The last word on homosexuality and Christianity has not been delivered in Toledo, yet.  The leadership of the Church on Strayer will surely load up and shoot back.  But Dr. Sprinkle said, “They are shrill in their condemnation of LGBTQ people because they know they have lost the cultural and moral argument about inclusiveness and diversity.  Homophobia is still potent in the Midwest and throughout America.  But the balance is tipping toward justice for marginalized people, the sorts of people Jesus himself was most comfortable around in his own day. Equality Toledo is on the right track,” Sprinkle added. “Answer hate with love.  We do not have to treat our adversaries as they have persecuted us. We have a God who turns enemies into friends.”

San Diego, California – On June 22, a wounded 31-year-old gay man struggled out of a gorge near the 1300 block of Washington Street, San Diego, and flagged down a passing motorist. He managed to tell the driver that he had been attacked with blows to his head from a rock before he fell unconscious from his injuries.  Police and paramedics responded, and Jason “Cowboy” Huggins was rushed to the Mercy Hospital trauma center where his condition deteriorated rapidly.  Huggins, a well-liked member of the San Diego LGBTQ community, fell into a coma, and two weeks later, on July 6, died from massive injuries to his head and brain from blunt force trauma.  He had been literally stoned to death. 10News.com reported that police arrested Joshua James Larson, 37, two days after the stoning, and charged him with the Huggins attack and a second assault charge in another case.  He is being held on $1 million for the crimes, and could serve from 33 years to life in prison if found guilty of the charges. Investigative reporting uncovered that Huggins had testified against Larson two years prior to the attack, alleging that Larson was guilty of drug possession and grand larceny. Though police have not issued a motive in the killing, and have not labeled the case a hate crime, revenge is suspected to be the motive.  Was the murderous attack motivated by anti-LGBTQ phobia?  The facts seem unclear about whether and to what extent that may have been a contributing factor. The nature of the attack, however, a prehistoric homicide with biblical overtones, caught the attention of the press. Even though sexual orientation has not been identified by the police as an aggravating factor in the murder of “Cowboy” Huggins, the San Diego LGBTQ community has rallied to his memory, and have raised money to help his relatives come to his funeral all the way from his native home in Clarksville, Tennessee, according to the San Diego Gay & Lesbian News. Huggins, who was easy to spot in the LGBTQ scene, was over 6 feet tall, and wore a cowboy hat, jeans, western shirt, boots, and a large, rodeo-style belt buckle.  In his Google Profile, he wrote, “I am a true cowboy from TN now living in sunny San Diego, CA. I am gay and have HIV too. Came out of the closet to all my redneck friends back in TN and was accepted because I am still a great friend that never overstepped my boundries.”  The New Civil Rights Movement notes that friends and family in his hometown of Clarksville knew about his sexual orientation and loved him very much. “We remember him being a kid with no aggressiveness in him at all,” Jennifer Sanders, Huggins’ aunt, said. “He was a fun-​loving, joking-​type of person, a very good kid. I call him a ‘kid’ because he was like my third child. We still can’t believe that it happened. It’s still a shock. He was only 31 years old. He’s going to be well missed by all of his friends out there in San Diego and his family.”  Faithful friends stood vigil for Cowboy Huggins from June 22 until his funeral day. So, Jason Baron Huggins was committed to his eternal rest on July 11 at Hillcrest in San Diego, attended by his family, friends, and a loyal LGBTQ community who loved him.  As one commenter on the Facebook event page wrote for all the world to see, “Rest in peace, Cowboy.”

Chatsworth, California – Larry King was murdered in cold blood in his first period computer classroom.  As he unsuspectingly worked on a paper on World War II, his middle school classmate, Brandon McInerney, allegedly moved up behind him and shot him in the back of the head before the unbelieving eyes of dozens of students and Ms. Joy Boldrin, his teacher. Then McInerney, who had been a party to harassing Larry for months about his gender non-conformity, pointed the .22 pistol again and delivered a coup de grace to Larry’s ravaged head.  In his landmark book,Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims (Resource Publications 2011) , Dr. Stephen Sprinkle treats the King/McInerney story at length, exploring the backgrounds and struggles of both teenagers. In the chapter, “Baby Boys, You Stay On My Mind,” Sprinkle sets Larry’s murder in the context of other assassinations of femininely presenting boys of color throughout the United States in early 2008.  Larry King fought back with the only power he had: his camp persona.  Half African-American, he was small, gracile, and not nearly as strong as the gang of boys, the “Young Marines,” surrounding Brandon McInerney. Larry learned to flirt in order to push back against his harassers. By the time of his murder, Larry was a five-year veteran of bullying in schools. McInerney, though slightly younger than Larry, was cultivating a “cool” image with middle school girls–an image aided by his overt harassment of Larry, “the little fag.” Underneath the surface of McInerney’s “cool,” though, was a budding white supremacist, whose confused masculinity chose violence as a way to silence the boy who turned the tables on him. Almost from the moment Larry’s murder hit the newswire, journalists started digging for dirt on the young gender outlaw.  Newsweek’s infamous article by Ramin Satoodeh labeled Larry a sexual aggressor in a blaze of controversial hot type. The Gun Lobby sprang into action to defend handguns. Larry’s partisans struck out at McInerney’s character, too. As Sprinkle details the journalistic feeding frenzy in the days following the murder, “these two boys were both abused by a media establishment determined to give a voracious public the news it was hungry to have: digestible pictures of a victim and his alleged killer to feed the insatiable American fascination with teen-on-teen violence.” 

Opening arguments in the McInerney trial, now taking place after three years of legal wrangling over Brandon’s status as a juvenile or an adult, and a critical change of trial venue, are busy following the lead of the media. Larry is being portrayed as a maladjusted predator (at 15? How is this possible?), and McInerney is being painted as a first-degree murderer who planned homicide in large part because of his homophobia and transphobia. The defense is indulging in a what amounts to the gay panic defense that has been discredited in courtrooms throughout the nation. Behind the defense strategy is the amazing idea that any expression of sexuality on the part of a gender non-conforming person makes violence legitimate in response. Just as Sprinkle surmised, the trial is going to turn on whether Larry King can be put on the stand as the chief malefactor instead of the defendant. As Sprinkle says, “There is a stark difference between the boys that no media wizard can resolve.  While Brandon remains alive and able to defend himself against the negative portrayals of his identity, Larry King cannot. He lost his voice in death” (Unfinished Lives, p. 284).

San Fernando Valley, California – The notorious execution-style murder of a 15-year-old, mixed race, gender variant student in his computer classroom made national headlines in February 2008–because his alleged murderer was barely 14.  There has been no doubt about the facts of the case. Brandon McInerney allegedly shot his gender non-conforming classmate, Lawrence Fobes “Larry” King in the back of the head while his teacher and dozens of his horrified classmates looked on in disbelief. McInerney had breathed threats against King to other students prior to the shooting, and showed apparent premeditation by bringing his grandfather’s .22 pistol to the E.O. Green Middle School classroom.  What has always been in dispute since the earliest reports of this heinous murder are the circumstances and state of mind that brought McInerney to the point of cold blooded murder.  Students reported that Larry King, who was living at a specialized home for abused and abandoned youth, was blatantly non-conforming in matters of gender and sexual performance.  King dressed in feminine clothing, wore high heels, and used makeup.  He answered the bullying culture of Southern California middle schools with what some have called defiance and others have named authenticity.  Larry King was “out,” and students in the Oxnard school he attended had problems with it.  None had a stronger aversion to King’s being and style than young Brandon McInerney, who displayed irritation and anger around King, and later, when King apparently developed something of a personal attraction to him, decided that extreme violence was the only answer to his rage and fear.  EDGE now reports that opening statements in the long-delayed trial of McInerney began Tuesday in a San Fernando Valley courtroom, rather than in Ventura County where the murder took place three years ago.  McInerney’s attorneys delayed and argued that their client was a juvenile, that the judge was biased, and that McInerney could not get a fair trial in Ventura County.  The defense team failed to keep their client out of court as an adult, and to force the judge to recuse himself or be removed.  But they did convince the court to move the venue of the trial, and by a battery of stalling tactics, to postpone the trial as long as possible so that memories of King’s murder would have the chance to fade.

National media debated the wisdom of trying a 14-year-old from a broken home as an adult, even though California law clearly mandated that a 14-year-old should stand trial as an adult in cases of murder.  Though the Golden State has some of the most progressive laws in the nation protecting LGBTQ residents, the atmosphere in schools throughout the state never has caught up with enlightened legal culture.  Bullying of gender variant youth in elementary, middle, and high schools in California is as rampant as anywhere in the nation, as highly publicized cases like the King-McInerney case demonstrate. King was permitted to come out and live fully as a youth in gender transition. While some gender variant students adopted a cautious demeanor in school, King used his budding femininity as a badge of honor.  Whether he had a genuine crush on McInerney during the Valentine season, or whether his actions and words were meant to make his classmate uncomfortable, we cannot really know. But the brute facts remain.  King is dead. McInerney, who life has been forever changed by this murder, is still alive.

The case will be watched closely by legal experts and LGBTQ youth advocates throughout the United States. If the prosecution succeeds in making the 1st degree murder charge stick, McInerney could serve time in prison until his fifties. If the defense succeeds in minimizing the murder of Larry King, it will be because of a likely combination of delay, genuine reluctance to convict because of the youth of the defendant, and a well-orchestrated defamation of a slain little person with a big gender variant profile, as the Los Angeles Times is already reporting from attorney arguments on the first day of this landmark trial. "Miss Nate Nate" Davis, 44, murdered transwoman

Houston, Texas – A 44-year old transwoman was shot to death behind a North Houston apartment dumpster just after midnight on Monday morning.  Known as “Miss Nate Nate,” the victim, née Nathan Eugene Davis, was pronounced dead on the scene.  Trans community members are rallying to call attention to this latest brutal murder perpetrated against the Houston transgender population.  Ms. Davis was known by merchants and residents in the area, and had contact with the police in the days prior to the fatal attack, according to Click2 Houston. The Houston Police Department has released a composite drawing of the suspect in the killing, described by witnesses as a 5’11″ tall African American male in his 20′s or 3o’s with a muscular physique.  No motive has been announced for the murder as of this writing. Issues of gender identity, self-naming, and popular misconceptions concerning transgender people are swirling around this story.  The local and regional media, picking up on the misreporting of the Houston Police as to the gender identity of the victim, have mis-identified Ms. Davis as a “man.”  For years, Ms. Davis chose to identify herself as a female, and lived her life accordingly.  Police are calling her a sex worker.  Most news stories reflect the none-too-sublte bias of law enforcement officers and media professionals, that the life choices, dress, and habits of the victim somehow explain why and how this crime happened.  The transphobia embedded in the culture often comes to the fore in such critical moments, when the character and legitimacy of whole populations of trans people are called into question by the dominant culture.  Ms. Davis was described by local merchants as “respectful,”"nice,” and “courteous.”  There are no leads to the whereabouts of her killer as yet but according to ABC News 13, a $5,000 reward for information leading to the arrest of the suspect has been posted as an incentive to the public.  A memorial of fresh-cut flowers and rainbow flags was placed near the site of “Miss Nate Nate’s” murder on Tuesday, thanks to the leadership of Cristan Williams, local activist.

Houston, Texas – Strategies for mobilizing the LGBTQ community to act for a safer Houston will be the focus of the concluding “Unfinished Lives” Session at Resurrection Metropolitan Community Church this Friday, 6:30 to 8:30 p.m. Dr. Stephen Sprinkle, professor at Brite Divinity School and author of Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims (Wipf & Stock Publishers, 2011), will offer Houstonians effective ways to prevent hate crimes, wrestle with with issue of anti-LGBTQ teen school bullying and suicide, and close ranks with transgender Americans to staunch the alarming number of violent attacks upon then in today’s world.  Attendance and enthusiasm remained strong at the June 10 session on lessons and insights the stories of hare crimes victims teach the wider community.  Dr. Sprinkle lifted up five lessons we stand to learn from LGBTQ people who have died because of their sexual orientation, gender identity, and gender expression.  In brief, these were: 1) confront head on the rising number of violent attacks against the queer community with educational efforts, 2) deal with the amnesia of the LGBTQ community, media, and the general public about queer hate crime murders, 3) begin the long-overdue conversation about transphobia and transgender hate crimes in America, 4) use the language of outrage when speaking about LGBTQ hate crimes, not the language of “tragendy,” and 5) the necessity of dealing with the religious and theological roots of anti-gay and transgender hate violence.  The stories of Ryan Keith Skipper of Wahneta, Florida and Talana Quay Kreeger of Wilmington, North Carolina were highlighted to illustrate Dr. Sprinkle’s lecture. MORGAN: Say a friend of mine like Elton John watching this at home, who with his partner – a civil partner, David Furnish – have just had a surrogate child which was born on Christmas day. They’re going to be pretty angry what they hear. They’re going to think who are you to call them a sinner.

J. OSTEEN: Yes.

MORGAN: But why are they sinners in your eyes?

J. OSTEEN: Well, it’s strictly back to what the scripture says. I mean, I can’t grab one part and say God wants you to be blessed and live an abundant life, and not grab the other part that says, you know what? You know, live that kind of life. So it comes back to the scripture. I’m not the judge. You know, God didn’t tell me to go around judging everybody.

Osteen tries to have it both ways in the interview with Morgan. Though he clearly condemns gay and lesbian people for parenting children, seeking marriage in monogamous relationships, and for forming same-sex loving families, Osteen claims that he is not a “gay basher.”  The distinction will surely be lost on queer folk and their families when the widely popular preacher has just clobbered them with the Bible.  ”The scriptures shows that it’s a sin,” Osteen says to Morgan in the CNN interview. “But you know, I’m not one of those that are out there to bash homosexuals and tell them that they’re terrible people and all of that. I mean, there are other sins in the Bible too…I don’t believe homosexuality is God’s best for a person’s life.”  Osteen has repeatedly peddled his own brand of “soft homophobia” as recently as November 2010 on television shows like ABC’s “The View,” as previously reported by the Unfinished Lives Project. Osteen betrays a simplistic form of Bible reading and interpretation that begins from a heterosexist and homophobic set of beliefs alien to the vast majority of reputable scholars and Bible teachers throughout the world. The Houston mega-church preacher apparently relies on a literalistic, legalistic reading of two texts in the entire Bible to arrive at his claim that God considers homosexuality a “sin.”  In the Hebrew Testament, only two passages in the priestly code of Leviticus (selected verses in Leviticus 18 and 20), and one primary text from Paul’s letter to the Romans which is actually about idolatry and not homosexuality in any modern sense (Romans 1:26-28) are available to Osteen and his ilk to make such a universally condemnatory argument against a marginalized group of people. The consensus of progressive and moderate Jewish and Christian biblical scholars is that fundamentalist interpretations of these passages are off base at best, and dangerous at worst. Opinions driven by cultural bias and read back into the Bible such as Osteen’s have proven to be used to justify their religious intolerance and violence by those who attack LGBTQ people both verbally and physically. For a responsible and accessible book on the Bible that teaches biblical respect for LGBTQ people, see Dr. Peter J. Gomes, “The Good Book.” While Osteen seems to think he can appeal to his conservative base with condemnatory statements like those on “Piers Morgan Tonight,” and at the same time soften his rhetoric enough to convince the gullible that he is the very nicest of gay bashers (so they can be “nice” gay bashers, too!), his use of the Bible is irresponsible, uninformed, and contributes to the suffering of millions of people whose only offense is whom they love.

Bayamón, Puerto Rico – A psychologist has informed the court in Bayamón that the alleged murderer of a popular transgender hair stylist is sane, and fit to stand trial for her murder.  EDGE reports that Emmanuel Adorno Ayala, 22, allegedly stabbed Ashley Santiago 14 times inside her Corozal, Puerto Rico home on April 19.  Santiago, 31, something of a local celebrity, was found dead, stripped naked in a large pool of blood in the kitchen of her home by police officers.  At the time of her murder, Pedro Julio Serrano, leading LGBTQ rights activist in Puerto Rico, urged authorities to investigate the homicide as a hate crime.  Transphobia has not been publicly established as a motive for the crime, but Serrano and other activists are monitoring developments closely.  Gender presentation and gender identity have become major media issues in Puerto Rico since the brutal murder of Jorge Steven López Mercado in November 2009 outside Cayey.  Mercado, a gay teen who presented femininely, was tortured, decapitated, and partially immolated by Juan A. Martínez Matos.  Matos was convicted of López Mercado’s grisly murder in May after confessing the murder, and was sentenced to 99 years in prison.  Much of the controversy swirling around anti-LGBTQ hate crimes in the United States territory is due to the official refusal to investigate and prosecute crimes under existing hate crimes laws.  Puerto Rico has hate crime law includes both sexual orientation and gender identity. Though the statutes took effect in 2002, prosecutors are reluctant to invoke it in obvious cases such as López Mercado’s and Santiago’s.
