Ohio Transgender Teen Commits Suicide, Cites Religious Zealot Parents’ Attempt to Control Her Life

Union Township, Ohio – A transgender teen girl chose to walk into the path of Interstate Highway traffic rather than face discrimination and harsh treatment for her gender expression. Cincinnati.com reports that Leelah Alcorn, 17, was struck and killed by an oncoming tractor-trailer truck at approximately 2:30 a.m. on Sunday, December 28, after leaving an extensive suicide note on her Tumblr account social media page. The driver of the truck, Abdullahi Ahmed, 39, was unhurt in the tragic incident that took place near the South Lebanon exit on I-71 because of his fastened seatbelt. Ms. Alcorn’s body was transported from the scene by the Warren County Coroner’s Office. Ohio Highway Patrol Officers are investigating what led Ms. Alcorn apparently to take her own life.

Ms. Alcorn whose account of rejection, alienation for her parents and school mates highlights the plight of transgender teens around the nation, left two notes on her blog, according to openly gay Cincinnati City Council man, Chris Seelbach : a suicide note, which may be read in its entirety on Councilman Seelbach’s Facebook Page here, and an apology note to the few friends Ms. Alcorn felt she still had at the time of her decision to take her own life. Ms. Alcorn, an M to F transgender youth whose chosen screen avatar was lazerprincess wrote that she had felt herself trapped in a male body since the age of four. In her suicide note which begins, “If you are reading this, it means that I have committed suicide and obviously failed to delete this post from my queue. Please don’t be sad, it’s for the better. The life I would’ve lived isn’t worth living in… because I’m transgender,” Leelah writes that her parents’ response to her discovery of her transgender identity contributed to a self-hatred that dogged her from age 14 until her death three years later. Her mother mandated that Leelah see conservative “Christian” therapists who only contributed to the burden of anger and depression.

The crisis apparently took place at the time of Leelah’s 16th birthday. She writes: “When I was 16 I realized that my parents would never come around, and that I would have to wait until I was 18 to start any sort of transitioning treatment, which absolutely broke my heart. The longer you wait, the harder it is to transition. I felt hopeless, that I was just going to look like a man in drag for the rest of my life. On my 16th birthday, when I didn’t receive consent from my parents to start transitioning, I cried myself to sleep.” In response to the inflexibility of her parents, Leelah came out as gay at school, believing that doing so would soften the effect of living into her true transgender persona. Her strict Christian parents responded by taking her out of public school, depriving her of any means of communicating with the outside world such as her cell phone and her laptop, and put her into virtual isolation for five months. “No friends, no support, no love,” Leelah wrote. “Just my parent’s disappointment and the cruelty of loneliness.” 

When she was finally allowed by her parents to communicate with others and see her one-time friends, Leelah relates that her excitement turned to deeper agony upon finding out that her classmates were little better than acquaintances who cared little for her true self. After a summer of depression, fearing the unknowns of college, grades, enforced attendance at a church where “everyone . . . is against everything I live for,” and what she believed to be the unreachability of transitioning, Leelah gave up hoping anything could get any better for her. “Either I live the rest of my life as a lonely man who wishes he were a woman or I live my life as a lonelier woman who hates herself, “ she wrote. “There’s no winning. There’s no way out. I’m sad enough already, I don’t need my life to get any worse. People say ‘it gets better’ but that isn’t true in my case. It gets worse. Each day I get worse.”

“That’s the gist of it, that’s why I feel like killing myself,” she wrote in an exhausted, heartbreaking coda to her final testament, struggling to explain who she really was by striking out her male birth name in her parting salutation. “Sorry if that’s not a good enough reason for you, it’s good enough for me. As for my will, I want 100% of the things that I legally own to be sold and the money (plus my money in the bank) to be given to trans civil rights movements and support groups, I don’t give a shit which one. The only way I will rest in peace is if one day transgender people aren’t treated the way I was, they’re treated like humans, with valid feelings and human rights. Gender needs to be taught about in schools, the earlier the better. My death needs to mean something. My death needs to be counted in the number of transgender people who commit suicide this year. I want someone to look at that number and say ‘that’s fucked up’ and fix it. Fix society. Please.”

Councilman Seelbach prefaced Leelah’s note with an appeal to his Facebook Friends to contribute what they could spare to TransOhio, so that in some measure, Leelah’s last wish that trans civil rights could somehow be advanced thanks to her having lived. Seelbach, the first openly gay Council Member to be elected in Cincinnati, writes: “While Cincinnati led the country this past year as the first city in the mid-west to include transgender inclusive health benefits and we have included gender identity or expression as a protected class for many years….the truth is….it is still extremely difficult to be a transgender young person in this country.
“We have to do better.” 

We at the Unfinished Lives Project could not agree more with Councilman Seelbach. Transgender youth in America, especially M to F persons, face unimaginable hurdles in the quest to become who they truly are. Seldom are we invited into the long, punishing agony trans teens endure. Leelah Alcorn died because her parents, her school, her society, and the religious underpinnings of the social and moral system of this country are hostile to non-normative gender identity and variant gender expression. Though she was 17 when she stepped into the path of a hurtling semi truck, she was still a child: vulnerable, confused, and above all, wounded. She took her own life. But she cannot be held responsible for the act that took her life. That indictment falls on a culture and heterosexist system in which we all play a part. LGBTQ and Straight alike. Councilman Seelbach declares what we must all resolve to do. Better. So much better, for the multitudes of youth like Leelah Alcorn who deserve a fair chance at the pursuit of happiness in a land that professes to stand for justice. “We have to do better.” Yes. French Homophobia Skyrockets 78%; Forces Reassessment of LGBTQ “Progress”

Paris, France – The number of documented homophobic attacks is ballooning out of control, says a report published by the French anti-homophobia watchdog, SOS Homophobie.  Since the passage of France’s pro-LGBTQ marriage law, advocates have been shocked by a rise of 78 percent in violent crimes against gay, lesbian, transgender, and bisexual residents in France during 2013.  The ominous meaning of this spike in violence in a supposedly “enlightened” European culture is forcing advocates, activists, and government officials to rethink narratives of progress on the issue of human equality.

SOS Homophobie, the only organization with reliable statistics on attacks against LGBTQ people in France, says that a violent physical attack against queer people is occurring no less than once every two days, and increase of 54 percent since 2012, but this statistic does not reflect the whole story.  The SOS Helpline received an astounding 3,500 calls in 2013, as opposed to 1,977 in all of 2012, registering an overall increase in anti-gay hate crime of the reported 78 percent.  “In the last twenty years the number of reports of incidents [of homophobia] received by our association have not stopped growing, but in 2013 they exploded,” notes the most recent SOS Homphobie report.  The report also found that the number of anti-gay insults online rose from 656 in 2012 to 1,723 cases in 2013, and the number of incidents that occurred in a school increased by 25 percent.

Justice and Interior ministries have been caught napping by these startling numbers, according to EDGEBOSTON.  An ideology of “inevitable progress” on matters of human rights has caused Gallic cultural leaders to be blindsided by the shift towards anti-gay rhetoric and physical violence since the legal embrace of same-sex marriage.  “There’s no doubt the rise in homophobic acts was linked to the context of the opposition against gay marriage,” Gregory Premon, spokesperson for SOS Homophobie, said to The Local. “Homophobic words and statements became trivialized during this period and helped legitimize insults and homophobic violence.”

A Dutch resident of northern Paris, who was punched and kicked senseless on a street near his home last month, has become the “face” of this new wave of anti-gay violence in France.  Wilfred de Bruijn’s skull was fractured in five places and he lost a tooth in the attack, according to The Independent.  He and his boyfriend Olivier were walking arm-in-arm at the time of the savage assault. “I woke up in an ambulance covered in blood, missing tooth and broken bones around the eye,” Mr. de Bruijn told The Local. “I’m home now. Very sad. Olivier takes care of me. Forbidden to work for at least 10 days.”  

Mr. de Bruijn places the blame for the attack upon the shoulders of anti-same sex marriage protestors, and a group has taken credit for the brutal act. Le Printemps Français (“The French Spring”), whose membership is believed to be largely comprised of hardline Catholics and royalists, now boasts that it sanctioned and carried out the assault against Mr. de Bruijn and his lover.  The shift from anti-LGBTQ marriage to a more general disgust against all queer and gender variant people is becoming more and more obvious.  As Mr. de Bruijn said to The Independent, “The [anti-gay-marriage campaigners] know very well what can happen if you repeat, repeat, repeat that these people are lower human beings. Of course, it will have a result.”

Though the French government has reacted with outrage to the news of the attacks on Messieurs de Bruijn and Olivier, and another recent gay victim, Mr. Raphael le Clerca in Nice, confidence in governmental authority to cause social change in such a charged environment has been seriously shaken in what was once a bastion of culture and forward thinking.  In the U.S. context, as well, the rise in Western European homophobia and heterosexism is not to be taken lightly.

While the Marriage Equality movement is advancing on the judicial front, most recently in the southern and western states of Arkansas and Idaho, it cannot be ignored any longer that incidents of anti-LGBTQ violence, especially against gay men and transgender people, has risen each year since the passage of the Matthew Shepard/James Byrd Jr. Hate Crimes Prevention Act in October 2009.  The heat of anti-gay rhetoric from the Religious Right Wing has intensified, and homophobic Christianist preachers like Scott Lively have pressed their hate agenda abroad wherever they have gotten the chance, in Russia and the Slavic countries of the former Soviet Union, and in Central Africa, for example.  While the attention of U.S. advocacy groups is upon Marriage Equality and a looming struggle in the U.S. Supreme Court, anti-LGBTQ attitudes have largely gone unaddressed, thanks to a blind belief in “inevitable social progress,” the irrelevance of domestic religious bigotry, and trust that the younger generations of Americans will finally tip the balance towards tolerance throughout the U.S. population.

We know, however, who is killing LGBTQ people in such alarming numbers in the U.S.A.: the very young who are supposedly their saviors.  The persons who murder and maim queer folk in the United States are predominantly young men from 17 to 35 years of age.  We also know that the under appreciated cultural power of religion to spawn false narratives of government oppression of “religious freedom” lies just below the surface of American society.  And American public and private schools are hotbeds of un addressed bullying and violence against gender variant youth, with outrageous consequences for vulnerable children every week in these United States.

The Marriage Equality movement is not essentially about changing foundational attitudes towards people of difference.  It is about stretching societal and cultural boundaries just enough to let same sex couples inside, where they can enjoy a similacrum of “normal life.”  Marriage is a conservative issue in American life, and always has been.  The serious and radical work of changing hearts and minds to accept challenging differences in society remains to be done, and cannot be ignored if Americans do not want to face the crisis their French allies are currently facing “just across the Pond.”

It is past time Americans take to heart the trenchant remarks of a French government spokesman outraged by the recent rise of homophobia in France: “The hatred and homophobic remarks have no place in our country and are punishable by law. The government strongly condemns these acts. These outbursts are unacceptable. When the most basic civil rights of our citizens are attacked, the authority of the state is at stake.”

Gay New Mexico Teen Is Latest Victim of School Bullying

Albuquerque, New Mexico – A gay New Mexico teenager took his life, despairing after years of incessant bullying by classmates.  Carlos Vigil, 17, posted a heart-wrending Twitter post on Saturday, July 13, finally crumbling under the weight of the epithets and ridicule his classmates put on him.  The tweet, posted as a screen capture by EveryJoe.com, reads in part: “I’m sorry to those who I offended over the years.  I’m blind to see that I, as a human being, suck.  I’m an individual who is doing an injustice to the world and it’s time for me to go. . . I’m sorry that I wasn’t able to love someone or have someone love me.  I guess it’s best, though, because now I leave no pain onto anyone.  The kids in school are right, I am a loser, a freak, and a fag and in no way is that acceptable for people to deal with.  I’m sorry for not being a person that would make someone proud.”

Ending his tweet, Carlos texted, “I am free now.”  His father, who ironically had only recently returned from a conference in North Carolina where he had spoken out against anti-gay bullying in schools, saw the tweet, and rushed home, too late.  Carlos was sped to the University of New Mexico Medical Center in a coma.  Late Sunday night, his parents requested that doctors remove life support from their son, after his organs had been harvested to benefit others.

The pathos and horror of anti-gay bullying scream out from the story of Carlos Vigil.  His mother said to reporters that her boy had been bullied in some form or another for being perceived as different and effeminate since he was eight years old.  Lately, she said, Carlos had been dogged by hateful speech about his sexual orientation, his acne, his glasses, and his weight.  He and his family tried valiantly to withstand the bullying, complaining to school officials, and transferring from a nearby high school to Valley High where the latest wave of bullying crashed over him.  Carlos had counseled and consoled others who were verbally attacked, and his parents were constantly checking in to ask how he was doing.  He had spoken out against bullying himself.  But according to the New York Daily News, no one guessed at the depth of his own personal anguish until his sudden, untimely death.  Eddie Vargas, sports director of Warehouse 508, an Albuquerque youth entertainment and arts center that Carlos helped to establish, said, “It’s an eye-opener that it can happen to anybody. The people we think are the most confident can also be the ones who are hurting the most.” 

We should no longer be surprised that gay youth like Carlos who show compassion for the hurts of others often swim in oceans of despair that they alone are helpless to overcome.  Carlos had deeply supportive parents who loved him just the way he was.  But the depth of the pain of a youth who had been bullied since the third grade was beyond usual measures of love, support, and affection.  Prevention is the best remedy for the multitude of LGBTQ and gender variant youth who take their own lives as a consequence of the rejection and hate speech to which they are subjected in school among their peers.  Teachers and administrators, clergy, health professionals, lawmakers, and cultural icons must act decisively to stem the tide of gay teen suicide by refusing to see LGBTQ youth as “the problem,” and, while knowing and acting on the signs of youth in trouble, must defend vulnerable boys and girls by making any hint of school bullying a serious offense.  Bullies need help, too.  So do the families of bullies who often enact what they hear at home, or act out from experiences of torment themselves.

Now, Carlos’s family is asking for everyone to work hard to prevent another useless, senseless death like his.  Early this morning, apparently unable to sleep well, his father and mother tweeted this note on their son’s Twitter account: “Carlos is finally at peace! Thank you everyone for your support and prayers. Please don’t forget what he wanted STOP THE BULLYING!”

Gay, Lesbian, Transgender Murders Skyrocket; Highest Hate Crime Murder Rate Ever Recorded

New York, New York – LGBTQH hate crimes murders in 2011 reached the highest number in recorded United States history, according to the annual report of the National Coalition of Anti-Violence Programs (NCAVP). The frightening statistics of gays, lesbians, bisexuals, transgender persons, and HIV-affected persons brutally murdered in homophobic hate crimes was released to the press on May 31. Among the highlights of the disturbing 2011 report:

  • The number of murders of LGBTQH people ROSE a full 11 per cent
  • 30 murders recorded; the highest number since the NCAVP has kept records
  • Transgender women, people of color, and gender variant youth are experiencing the most severe assault of violence against them
  • 87 per cent of these murders befell LGBTQH people of color
  • This high murder rate is the third year in a row (2009, 2010, and now 2011) that shows hate crimes killings rising
  • Youth and Young Adults were 2.41 times more likely to have been physically attacked in bias-related crimes than the general LGBTQH population
  • Transgender women comprised 40 per cent of the murder totals, making the second year in a row that Transwomen faced violence in outsized proportions to their numbers in the LGBTQH community

Even though the report shows a 16 per cent decrease in bias-related acts of violence against the LGBTQH community, an encouraging trend, the decrease is overthrown by the alarming jump in hate crimes murders. Detroit, Michigan, for example, showed a major increase in violence against transgender people, prompting Nusrat Ventimiglia of Equality Michigan to note that much of their budget was being consumed in response to the hike in the murder rate in the queer community. Rebecca Waggoner of OutFront Minnesota said that the outrage of youth murders and suicides demands more money and staff on the part of anti-violence programs nationwide to address the epidemic of death among gender variant young people.

Since the Matthew Shepard/James Byrd Jr. Hate Crimes Prevention Act was signed into law by President Obama in October 2009, the incidence of homophobic, biphobic, and transphobic murder has increased year by year, indicating that vigorous prosecution of killers is demanded by the U.S. Justice Department, the FBI, and all branches of state and local law enforcement.  NCAVP’s New York City Anti-Violence Co-ordinator, Chai Jindasurat, said to the media: “NCAVP’s findings are a call to policymakers, advocates, and community members that the prevention of violence against LGBTQ and HIV-affected individuals needs to be a priority.” The report includes specific  policy changes that may reduce the increasing trend of these murders, including an increase in funding for LGBTQH anti-violence support and prevention, and a concentrated effort to bring an end of the homophobic, transphobic, and biphobic culture that fuels hate violence.

18 states do not currently include sexual orientation in their hate crimes statutes, and 22 states do not include gender identity or gender expression. This lack of state concern for LGBTQH victims of hate crime allows the suspects of anti-gay or anti-transgender acts to believe they can carry out their bias crimes against the queer community with impunity. Even when a state has a hate crimes law on the books, like Texas, the rarity of its use by local law enforcement and district attorneys emboldens homophobic killers to carry out their irrational violence without fearing prosecution.

Remembering Sakia Gunn (1987-2003): A Special Comment on Her Birthday

Newark, New Jersey – On Saturday, Sakia LaTona Gunn would have been 25 years old–but instead, she was murdered by a homophobe on the make for young lesbians.  Sakia’s story never got the press attention other LGBTQ hate crimes murder victims did.  She was a young, black, poor girl from the wrong side of the Hudson River.  But among those who know her story, there is great power for change still waiting to be released until justice finally comes for Sakia–and for all queer youth caught in the national nightmare of violence against young people of color that just won’t seem to go away.

The narrative of her last night is chilling.  Sakia and her friends returned from a great day at the Chelsea Piers over in the Big Apple.  They laughed, joked, sneaked drinks, and held each other in a blissful freedom they did not know back home.  Late, late–or early, depending on how you keep time–Sakia and her friends stood waiting for a bus to pick them up at one of the busiest bus stops in Newark, when two older, much more powerful men drove by cat-calling at them, trolling for something young and vulnerable.  They recognized that the girls were Aggressives–gender non-conforming youth who lived the hip hop life as fully as they could.  And something snapped within Richard McCullough when his blandishments were rejected by Sakia.

When McCullough, much larger and stronger than any of the girls he attacked, moved against her friends, Sakia defended them with her life.  McCullough stabbed her in the chest with a switchblade knife, later lamely claiming that she had “run” onto the knife he somehow was wielding in self defense.  Neither the jury nor the judge bought his story, and he was convicted of manslaughter in a plea bargain and sentenced to 20 years (rather than face a murder charge and be subject to far more prison time).

Sakia’s funeral was huge.  Over 2,500 people attended the wake, though it was only slightly covered in the gay media, and virtually not at all in the mainstream press–a fact that has been controversial ever since her story broke.  Racism and sexism played their part in dampening the story, as did Sakia’s self identification as a lesbian Aggressive, effectively rendering her a minority within a minority.  A courageous filmmaker, Chas Bennet Brack, worked tirelessly to bring Sakia’s story to the big screen as a documentary.  “Dreams Deferred: The Sakia Gunn Film Project” became an award winner at film festivals around the country.  Sakia’s story became a subject of research, scholarship, and artistic interest, with plays, articles, and books dedicated to her memory.  Among them is the IPPY Award winning Unfinished Lives: Reviving the Memories of LGBTQ Hate Crimes Victims (Resource Publications, 2011), by Stephen V. Sprinkle, the founder and director of the Unfinished Lives Project.

Against the odds, Sakia Gunn intended on being a basketball star.  She found love and friendship in plenty during her woefully shortened life.  But her story persistently clamors for attention, crying out for justice for youth of color, queer people, and economically disadvantaged persons of all races and backgrounds.  Though she never wished it, she has become an ongoing inspiration–a brave young woman unafraid to be who she was in a hostile world, one who defended her friends.  What greater love can anyone have than that?

The Outrage of Pulpit Homophobia: A Special Comment By a Baptist

Fayetteville, North Carolina – Pastor Sean Harris did not make news around the blogosphere because he preaches against gay people. He should have, of course, and been opposed for it. But homophobic messages from American pulpits are given passes every Sunday of the world. Because he got caught fanning the flames of homophobic bullying against children, however, he has become an infamous example of what can no longer be tolerated in any pulpit anywhere. In a sermon at Berean Baptist Church in Fayetteville, home to Fort Bragg, Pastor Harris shouted that any “limp-wristed” boy acting like a girl should be punished with physical violence.  His wrist should be “cracked” and he should receive the blows of his father’s fists, the preacher said with great enthusiasm.  Girls were not left out of his sights, either.  Pastor Harris went on the say that girls could “play sports,” but they were supposed to conform to his notions of what a girl looked like, dressed like, acted like, and “smelled like.”

“Smelled like”? Pastor Harris’s sermon does not pass the “smell test.”  Love of God and neighbor are apparently foreign to him, and the shouts of affirmation he received as he preached his homophobic message had nothing to do with the Good News. His message of harsh punishment smells like something dying, not something being born again. Sadly, there are too many like him in the pulpits of this nation, so-called men of God who give God, Christ, and the Holy Spirit a bad name.

It doesn’t take a theologian to know what Pastor Harris is up to.  He is trying to say that God hates gay people, even those in the larval stage. He is a strong supporter of North Carolina’s proposed anti-difference amendment to the state constitution, Amendment One, which will be voted on shortly in the Old North State.  Same-sex marriage is already illegal in North Carolina, but pulpit politicians like Harris want to inscribe discrimination in the constitution of the only southern state in the country that has had the good sense not to do so yet.  So, Pastor Harris feels free to advocate violence against children who are stereotypically suspected of being gay.

Pastor Harris is abusing his pulpit in the name of a homophobia embedded within him, and which he reads back into scripture and Christian faith–a practice that is controversial at the very least, and has been repeatedly shown to be false by ministers, scripture scholars, and church leaders for decades.  It is the oldest ministerial slight-of-hand in the Christian faith: find an outcast group it seems safe to demean, then proof text a Bible verse to support your bias (but be sure to wash your hands of the violence your words inspire and the attacks people you instigate carry out!).  Jews, Blacks, women, and now gay people and their supporters in North Carolina know all about it.  And it is no longer tolerable or acceptable for other Christians to put up with silently any longer.  Where is the outcry from clergy?  From church members who know better? Where is the demand that religion based bigotry must stop?  Where are the voices of school administrators, teachers, and school board members who know full well that attitudes and advocacy like Harris’s lead to children being bullied to death in classrooms and school playgrounds?

Pastor Harris now says he wants to “retract” his advice about parental violence against their children.  But he defiantly affirms that he still hates sinners like gay people, calling them “abominations,” homophobic biblicism’s shorthand for the worst curse imaginable.  I would hope he changes his mind and heart about his fellow human beings, the ones God loves just as much as God loves his Berean Baptist flock.  But I am not holding my breath until he does.  I have worked educating ministerial students, speaking on panels in schools and universities, and writing on the role religion based homophobia plays in hate crimes for decades, and these two things I have learned about “true believers” like this pulpit abuser: You cannot take out of a person by rationality what rationality did not put into him. Neither can appeals to humanity change a heart of stone.

Though I suspect he would argue with me until Judgement Day, I know that every child is precious in the sight of God–even those who will one day identify as gay, lesbian, transgender, or something else.  God doesn’t make junk.  And, contrary to the homophobia he was taught somewhere and seems to have swallowed whole, being gay, just like being straight, is a gift from God, too.

One other thing is sure: what Pastor Harris is preaching about the gender identity and expression of children did not come from God.

Plea Deal for Larry King’s Murderer: The Inside Story

Brandon McInerney pled guilty to the execution-style murder of his gay teen classmate, Larry Fobes King.

Ventura County, California – Prosecutors in the Brandon McInerney murder trail agreed to a plea deal rather than take young gay Larry King’s confessed killer into court a second time, according to EDGE Boston.  McInerney, 14 at the time he shot his 15-year-old gay classmate in the back of the skull in his middle school computer class in 2008, will be sentenced today.

The Ventura County District Attorney’s Office agreed to a deal because they couldn’t be sure what would happen if they put McInerney back on trial again.

McInerney’s defense team succeeded in putting King on trial for his own murder, at least enough so that the jury in the first trial could not agree on a verdict, and a mistrial was declared.  While legal experts saw the case as a clear-cut instance of pre-meditated murder, the prosecutors for Ventura County could not surmount the sympathy factor for the 14-year-old, and the discomfort factor in the way the press and the defense portrayed King.  Instead of the forthright homophobic murder the prosecution sought, a combination of child-nostalgia and anti-transgender and anti-gay bias turned King into a “Franken-Larry,” a devious, dangerous homosexual predator–a portrayal that could not have been further from the truth about the real boy who was in transition from a scared, bullied gay school kid to a youth who could affirm and live out his gender variance.

Media distortion in the King case started as early as the first reports about the murder, with sensational accounts of what young King wore to school, and his responses to McInerney’s bullying.  Ramin Satoodeh, reporter for Newsweek, wrote a cover story on King that was devastating–likening the boy to a monstrous little predator, tottering after his love interests in platform heels.  McInerney’s defense lawyers countered prosecution evidence of his Neo-Nazi and white supremacist motives by casting King, who was smaller and weaker than McInerney, as the aggressor, and skillfully used the press to drive this point home.  The California law making a 14-year-old prosecutable as an adult in heinous cases using firearms (which this case was in both particulars) was also put on trial in the media.

In the end, justice for Larry King was not the goal of a chastised district attorney’s office.  Assistant DA Mike Frawley said that they “took into consideration the time [McInerney would have to spend] in jail to protect the community.”  McInerney’s murder conviction has been stayed, and he will be sentenced to 11 years for voluntary manslaugher, and 10 years for the use of a firearm. With the four years he has already served in jail, McInerney will serve 25 years total.  Had the first-degree murder conviction been impose, he would have served 51 years.  Now, the confessed murderer of a young gay boy will be out on the street by his 39th birthday, and the dubious “gay panic defense” receives new life in the American legal system.

UN Defends Gay Rights; Calls for the End of Homophobic Violence

Geneva, Switzerland – A hard-hitting, historic report calling on the nations of the world to defend the rights of gay people has been issued by the Office of the High Commissioner of Human Rights of the United Nations in Geneva.  For the first time, the world body has detailed the the murder, bias-motivated violence, torture, police detention, discrimination in jobs, health care and education that LGBT people face on a daily basis because of their actual or perceived sexual orientation or gender identity.  The report, which may be accessed here, was released on December 15 in response to the high number of reports of anti-gay human rights abuses flowing into the international body, according to the UN News Service.

In part, the report states, “The criminalization of private consensual homosexual acts violates an individual’s rights to privacy and to non-discrimination and constitutes a breach of international human rights law.”  Decrying violence against LGBT persons, the High Commissioner concludes that “Homophobic and transphobic violence has been recorded in all regions . . . Violence against LGBT persons tends to be especially vicious compared to other bias-motivated crimes.”  Data show that homophobic hate crimes often include “a high degree of cruelty and brutality.”

The hate crimes statistics in the report are horrific.  Lifting up the transgender and gender variant population, the High Commissioner reports, “The Trans Murder Monitoring project, which collects reports of murders of transgender persons in all regions, lists 680 murders in 50 countries during the period from 2008 to 2011.”  That said, the effort to collect data on murder and other acts of physical violence against LGBT people is complicated by the practice of nations around the world, either neglecting to collect these statistics, or outright refusing to allow their collection.

While over thirty nations have decriminalized homosexuality in the last two decades, 76 countries still make consensual acts between same-sex persons illegal, and at least five, Iran, Mauritania, Saudi Arabia, Sudan and Yemen, make homosexual conduct punishable by death.

The High Commissioner, Navi Pillay, calls upon the nations of the world to “Repeal laws used to criminalize individuals on grounds of homosexuality for engaging in consensual same-sex sexual conduct, and harmonize the age of consent for heterosexual and homosexual conduct; ensure that other criminal laws are not used to harass or detain people based on their sexuality or gender identity and expression, and abolish the death penalty for offences involving consensual sexual relations.”

Further, High Commissioner Pillay “calls on countries to ensure that no one fleeing persecution because of their sexual orientation or gender identity is returned to a territory where their life or freedom is at threat, and that asylum laws recognize that sexual orientation or gender identity is a valid basis for claiming persecution,” according to the UN News Service.  Ms. Pillay also recently held press conferences appealing to member nations to abolish homophobic bullying leading to the suicide of young LGBT people.

The report intensifies the call to member nations, issued last year by UN General Secretary Ban Ki-moon, to “reject discrimination in general, and in particular discrimination based on sexual orientation or gender identity.”

McInerney Pleads Guilty to 2nd-Degree Murder for Executing Larry King

Ventura County, California – The teen killer of a gay classmate has pleaded guilty second-degree murder.  Brandon McInerney, 17, 14-years-old at the time he pulled the trigger, shot gay 15-year-old Larry King in the back of the head execution-style at E.O Green Middle School in Oxnard, California in February 2008 before the eyes of his first-period classmates.  The facts of the case are undisputed.  Rising behind his victim, McInerney pumped two rounds into the back of Larry King’s skull, fulfilling a threat he made to a girlfriend at school the day before.  McInerney will receive a 21-year sentence for a crime that many say bears all the hallmarks of a pre-meditated, first-degree hate crime murder.

In September of this year, a mistrial was declared after two months of testimony, due to the inability of the jury to come to a decision about the guilt of young McInerney.  Prosecutors had argued for first-degree murder, based on the established pre-meditation and the heinous nature of the crime.  Under California law, a 14-year-old may be tried as an adult, and McInerney, who confessed to the murder seemed to fit the statute’s requirements. Prosecutors claimed that because of McInerney’s antipathy toward King’s sexual orientation and gender expression, and because of white supremacist loyalties the killer clearly embraced, the murder was a clear-cut case of anti-LGBT hate crime.  Defense turned the tables on the prosecution, putting the dead victim on trial instead of their client.  They resurrected the infamous “gay panic/trans panic” defense, drumming their contention into the jurors’ minds that King was the prime aggressor, pressing his flamboyant sexuality toward McInerney until he “snapped.”  Enough of the jury bought the ploy that the jury hung. Had the first-degree charge been upheld, the defendant would have received 53 years for his crime.

The Advocate reports that formal sentencing will take place for McInerney on December 19. Twenty-one years in prison is a long time for McInerney to consider that every day he lives is another he stole from a gay classmate because of his discomfort with a person who was different. For the LGBTQ community, the specter of the “gay panic defense,” like a hungry ghost, lingers on, given new energy by this plea deal.

Gay Men and Trans People in the Cross Hairs: Behind the FBI’s 2010 Hate Crimes Statistics

Washington, D.C. –  Hate crimes statistics for 2010 are out from the Federal Bureau of Investigation.  The good news is that, overall, the numbers of reported hate crimes last year held steady.  The FBI report, accessible here, documents 6,624 single-bias incidents, which range from acts of vandalism to cold blooded murder. Four more incidents encompassed multiple-biases, making for a grand total of 6,628 incidents reflecting 7,699 offenses as reported voluntarily by law enforcement agencies around the nation.  These data represent a serious undercount of the actual number of hate crimes perpetrated against Americans during the last year, since 1) reportage by local law enforcement is sheerly voluntary with no funding from the federal government to aid small jurisdictions to report, and 2) local law enforcement officials are often loathe to classify an incident as a hate crime because of a variety of reasons, such as how the community regards social groups and racial/sexual minorities.

Behind the statistics are the stories of flesh-and-blood victims and their families, and the news here is disturbing. 1,528 victims were targeted because of animus against sexual orientation.  Of these, 57.3 percent of victims were gay males, and 11.9 percent were lesbians. The numbers of violent attacks against transgender people are fragmentary at this point, since statistics of this particularly vulnerable group have only been recorded by the FBI since the Matthew Shepard-James Byrd Jr. Hate Crimes Prevention Act was signed into law by President Obama in October 2009.  But the news of brutalities against transgender people, especially transgender women of color, is alarming.  GLAAD reports that, of the people murdered for sexual orientation and gender identity and expression bias, 70 percent were persons of color, and 44 percent were transgender women [NCAVP figures]. Though suicides of LGBTQ teens due to homophobic and transphobic bullying in schools have captured the headlines repeatedly since 2010 began, no separate FBI statistical category yet exists for the collection of these data.

In the recent Civil Rights Conference on Hate Crimes at the University of Texas at Arlington, Assistant Attorney General Thomas Perez declared in his keynote address, “We are experiencing a headwind of hatred and intolerance in the United States.” FBI Special Agents appealed to local law enforcement, U.S. Attorney officials, and leaders from the North Texas LGBTQ community to co-operate in the reporting of hate crimes, underlining the difficulty feds are experiencing amassing accurate data.   In its 2010 report, the National Coalition of Anti-Violence Programs (NCAVP), widely held to offer more accurate statistics on anti-LGBT hate crimes than the FBI, noted a 13 percent rise in homophobic and transphobic violence from 2009 to 2010, and a 23 percent rise in the murders of LGBTQ people.
